AMENDMENT 127A FOR THE INTRODUCED BILL

An Act to transfer certain funds, make an appropriation to provide horse racing relays, and to declare an emergency.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. The Gaming Commission shall transfer from the special racing revolving fund and the South Dakota-bred racing fund, an amount allocated from each fund not to exceed a combined total of one-hundred and twenty thousand dollars, to the general fund.

Section 2. There is hereby appropriated from the general fund the sum of sixty thirty-two thousand dollars ($60,000)($32,000), or so much thereof as may be necessary, to the Department of Tribal Relations, for purposes of awarding grants to provide Indian horse racing relays in South Dakota. The Department of Tribal Relations may only award grants to entities registered with the Secretary of State to provide Indian horse racing relays.

Section 3. The secretary of the Department of Tribal Relations shall approve vouchers and the state auditor shall draw warrants to pay expenditures authorized by this Act. The Department of Tribal Relations shall report after the conclusion of fiscal year 2021 to the Government Operations and Audit Committee concerning the expenditures authorized by this Act.

Section 4. Any amounts appropriated in this Act not lawfully expended or obligated by June 30, 2021 shall revert in accordance with the procedures prescribed in chapter 4-8.

Section 5. Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
