AMENDMENT 1128A FOR THE INTRODUCED BILL

An Act to modify the penalty for causing a child to be present during methamphetamine use, distribution, or manufacture.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That § 26-10-31 be AMENDED:

26-10-31. Methamphetamine--Use, distribution, or manufacture in presence of child--Violation as felony or misdemeanor.

It is a Class 4 felony for any person to knowingly cause a child under the age of fourteen years, or an unborn child, to be present where any person is using, distributing, or manufacturing methamphetamine. It is a Class 1 misdemeanor for any person to knowingly cause a child age fourteen years or older to be present where any person is using, distributing, or manufacturing methamphetamines methamphetamine.
