AMENDMENT 1041B FOR THE INTRODUCED BILL

An Act to revise provisions authorizing state employees to opt-out of the state employee health plan and to declare an emergency.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That § 3-6E-4 be AMENDED:

3-6E-4. Enrollment of all eligible employees--Exception.

Each plan-eligible employee shall be enrolled in the plan unless the employee is covered by another group health plan either as a dependent or spouse or is covered by Medicare and the employee provides notice to the plan administrator.

Section 2. Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
