     WHEREAS,  pursuant to the provisions of §  4-2-2, the auditor general shall be appointed by a Concurrent Resolution of the State Legislature; and

     WHEREAS,  the Executive Board of the Legislative Research Council has recommended the reappointment of Marty Guindon of Pierre, South Dakota, to continue in that position:

     NOW, THEREFORE, BE IT RESOLVED,  by the Senate of the Eighty-fourth Legislature of the State of South Dakota, the House of Representatives concurring therein, that Marty Guindon of Pierre, South Dakota, be reappointed to the office of auditor general, pursuant to the provisions of §  4-2-2, for the term of eight years from adoption of this Concurrent Resolution, and until a successor is duly appointed and qualified; and

     BE IT FURTHER RESOLVED,  that the secretary of the Senate of the State of South Dakota transmit an enrolled copy of this Concurrent Resolution to Mr. Guindon, the secretary of state, and the Governor of the State of South Dakota.

     SB 82: FOR AN ACT ENTITLED, An Act to provide for the right to possess a firearm on the campuses of public institutions of higher education.

     Was read the second time.

     Sen. Nesselhuf moved that SB 82 be amended as follows:

     On page 1, after line 12 of the printed bill, insert:

    "Section 3. That § 22-14-22 be repealed.

     22-14-22.   For the purposes of §§ 22-14-23 to 22-14-28, inclusive, the term, county courthouse, means the state capitol or any building occupied for the public sessions of a circuit court, with its various offices. The term includes any building appended to or used as a supplementary structure to a county courthouse.

     Section 4. That § 22-14-23 be repealed.

     22-14-23.   Except as provided in § 22-14-24, any person who knowingly possesses or causes to be present any firearm or other dangerous weapon, in any county courthouse, or attempts to do so, is guilty of a Class 1 misdemeanor.

     Section 5. That § 22-14-24 be repealed.


     22-14-24.   The provisions of § 22-14-23 do not apply to:
             (1)      The lawful performance of official duties by an officer, agent, or employee of the United States, the state, political subdivision thereof, or a municipality, who is authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of law or an officer of the court;
             (2)      Possession by a judge or magistrate;
             (3)      The possession of a firearm or other dangerous weapon by a federal or state official or member of the armed services if such possession is authorized by law; or
             (4)      The lawful carrying of firearms, or other dangerous weapons in a county courthouse incident to hunting, or gun safety course or to other lawful purposes.

     Section 6. That § 22-14-25 be repealed.

     22-14-25.   Nothing in this chapter limits the power of a court to punish for contempt or to promulgate rules or orders regulating, restricting, or prohibiting the possession of weapons, within any building housing such court or any of its proceedings, or upon any grounds pertinent to such building.

     Section 7. That § 22-14-26 be repealed.

     22-14-26.   Notice of the provisions of § 22-14-23 shall be posted conspicuously at each public entrance to each county courthouse.

     Section 8. That § 22-14-27 be repealed.

     22-14-27.   It is not a defense to a prosecution under § 22-14-23 that the defendant was the holder of a concealed weapons permit issued pursuant to §§ 23-7-7 and 23-7-7.1.

     Section 9. That § 22-14-28 be repealed.

     22-14-28.   By a majority of the members-elect, the county commission in any county may elect to waive the provisions of § 22-14-23. ".

     WHEREAS,  Greg Smeenk is a third generation rancher, born and raised on a ranch northeast of Newell, where he learned the value of an honest day's work and the commitment of a handshake; and

     WHEREAS,  Greg Smeenk has a lifetime of experience in agriculture giving him the ability and knowledge to successfully assist buyers and sellers with their real estate needs for over four years; and

     WHEREAS,  Greg Smeenk was selected the Top Selling Agent of the Northern Black Hills Association of Realtors in 2008 out of 154 competitors, with $12 million in total volume moved:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eighty-fourth Legislature of the State of South Dakota, that Greg Smeenk be congratulated for earning the distinction of being named Top Selling Agent of the Northern Black Hills Association of Realtors and commended for his dedication to professional service as a realtor.

     Sen. Haverly moved that the Senate do now adjourn, which motion prevailed and at 5:23 p.m. the Senate adjourned.
