     Section 3. That chapter 58-8 be amended by adding thereto a NEW SECTION to read as follows:

     The provisions of this Act do not apply to any charity that meets all of the following criteria:

             (1)    Is organized as a benevolent nonprofit 501(c)(3) organization;

             (2)    Publishes an IRS Form 990 online;

             (3)    Annually submits an independently audited financial statement to the Division of Insurance; and

             (4)    Provides to the public, at request, the audited financial statement described in subdivision (3).".
