     The Senate convened at 12:00 p.m., pursuant to adjournment, the President presiding.

     The prayer was offered by the Chaplain, Rev. Levi Willms, followed by the Pledge of Allegiance led by Senate page Shelby Freeman.

     Roll Call: All members present except Sens. Gillespie and Gary Hanson who were excused.

APPROVAL OF THE JOURNAL

MR. PRESIDENT:

     The Committee on Legislative Procedure respectfully reports that the Secretary of the Senate has had under consideration the Senate Journal of the third day.

     All errors, typographical or otherwise, are duly marked in the temporary journal for correction.

     And we hereby move the adoption of the report.

Dear Mr. President and Members of the Senate:

    Pursuant to the provisions of Chapter 1-45 of the South Dakota Codified Laws and subject to your consent, I have the honor to inform you that I have appointed Stacy Phelps, Pennington County, Rapid City, South Dakota, to the South Dakota Board of Education.

    This appointment was effective April 8, 2008, and shall continue until December 31, 2008.

    Stacy Phelps was reappointed to the South Dakota Board of Education on December 29, 2008, and shall continue until December 31, 2012.

REPORT OF STANDING COMMITTEE

    The Committee on State Affairs respectfully reports that it has had under consideration SB 63 and 64 and returns the same with the recommendation that said bills do pass.

CONSIDERATION OF REPORTS OF JOINT-SELECT COMMITTEES

    Sen. Knudson moved that the report of the Joint-Select Committee relative to the distribution of legislative documents as found on page 52 of the Senate Journal be adopted.

    Sen. Knudson moved that the report of the Joint-Select Committee relative to the memorial service for deceased former members as found on page 53 of the Senate Journal be adopted.

MR. PRESIDENT:

    I have the honor to inform your honorable body that the House has adopted the report of the Joint-Select Committee for the purpose of arranging legislative days for members, officers, and employees of the House and Senate.

Also MR. PRESIDENT:

    I have the honor to inform your honorable body that the House has adopted the report of the Joint-Select Committee relative to the Joint Rules for the two houses for the Eighty-fourth Legislative Session.

Also MR. PRESIDENT:

    I have the honor to inform your honorable body that the House has adopted the report of the Joint-Select Committee relative to setting the compensation schedule for the elective and appointive officers and members of the Eighty-fourth Legislative Session.

Also MR. PRESIDENT:

    I have the honor to inform your honorable body that the House has adopted the report of the Joint-Select Committee for the purpose of securing chaplains for the Eighty-fourth Legislative Session.

MOTIONS AND RESOLUTIONS

     HCR 1001: A CONCURRENT RESOLUTION, Urging Congress to pass a well-funded, multi-year federal highway program in a timely manner.



    Was read the second time.

     Sen. Bradford moved that the Senate do concur in HCR 1001 as found on page 14 of the House Journal.

     The question being on Sen. Bradford's motion that the Senate do concur in HCR 1001.
