    The Committee on Education respectfully reports that it has had under consideration SB 213 and returns the same with the recommendation that said bill be amended as follows:

    On the printed bill, delete everything after the enacting clause and insert:

"    Section 1. That § 13-13-73.6 be amended to read:

    13-13-73.6. The Department of Education shall calculate the following for each school district:

            (1)    The average teacher salary, based on data collected pursuant to §§ 13-8-47 and 13-3-51;
            (2)    The increase in local need pursuant to § 13-13-10.1, excluding any effect due to change in the school district's fall enrollment and less the amount of revenue generated in school fiscal year 2016 pursuant to § 13-10-6 as a percentage increase, from fiscal year 2016 to fiscal year 2017; and
            (3)    The increase in average teacher compensation as a percentage increase, as defined in § 13-8-47, from fiscal year 2016 to fiscal year 2017.

    For each school district, the district's increase in average teacher compensation from fiscal year 2016 to 2017 shall be equal to at least eighty-five percent of the district's increase in local need, as defined in subdivision (2), from fiscal year 2016 to fiscal year 2017 and, notwithstanding any negotiated agreement, at least eighty-five percent of the increase in state aid to general education funding the school district receives for fiscal year 2017 less the amount of revenue generated in fiscal year 2016 pursuant to § 13-10-6 shall be used to increase instructional salaries and benefits for certified instructional staff.

    If a district fails to comply with the requirements of this section, state aid to general education funding to the district in fiscal year 2018 shall be decreased by an amount equal to fifty percent of the amount calculated in subdivision (2). For fiscal years 2019, 2020, and 2021, if a district's average teacher compensation is less than the district's average teacher compensation in fiscal year 2017, state aid to general education funding to the district in the following fiscal year shall be reduced by an amount equal to five hundred dollars for each teacher employed in the school district. However, if the Legislature fails in any fiscal year to increase the average teacher salary by the index factor outlined in § 13-13-10.1, the accountabilities under this section are suspended for that fiscal year but may not fall below the 2017 level.

    A school district may request a waiver from any penalty imposed under this section from the School Finance Accountability Board. "

        A LEGISLATIVE COMMEMORATION, Commending and honoring the 2017 Sioux Falls Lincoln High School Patriot Marching Band for its many accomplishments.

    WHEREAS, the Lincoln High School Patriot Marching Band is one of the largest band programs, with 244 members including color guard members and was led under the direction of head director, Mr. Dan Carlson, and assistant director, Mr. Sam Anderson; and

    WHEREAS, the Lincoln High School Patriot Marching Band 2017 season featured the field show "The Underground" including the following musical selections: "Sing, Sing, Sing" by Louis Prima, "Impossible Year" by Panic at the Disco, "Symphony No. 2" by Dmitri Shostakovich, and "Children's Hour of Dreams" by Charles Mingus; and

    WHEREAS, the Lincoln High School Patriot Marching Band began their season in Marshall, Minnesota, for the Pursuit of Excellence Field Competition, where the band earned the sweepstakes trophy and every possible caption including best drumline, front ensemble, color guard, brass, woodwinds, music execution, visual execution, drum majors and general effect. The Lincoln High School Patriot Marching Band also placed first in Class AAAA Parade and in Class AAAA Field Competition at the Tri-State Band Festival in Luverne, Minnesota, and also earned the sweepstakes trophy and every possible caption; and

    WHEREAS, the Lincoln High School Patriot Marching Band traveled to Brandon for the Big Sioux Review Competition and won all captions and the sweepstakes trophy. The band traveled to Minneapolis, Minnesota, to compete in the Youth in Music Field Championship. Out of 27 bands, the band came in 3rd overall in the finals competition and won best colorguard; and

    WHEREAS, the Lincoln High School Patriot Marching Band capped its competition season with two thrilling performances at the Bands of America St. Louis Super Regional Championship. Lincoln captured 2nd place in its class and 10th overall in a field of 65 bands

from 11 states. They additionally earned a coveted spot in the Championship Finals where they competed against some of the top ranked bands in the nation, finishing in 13th place:

    WHEREAS, Corporal Branden Stackenwalt has served his country and our military with honor and distinction in deployed tours of both Iraq and Afghanistan; and

    WHEREAS, Branden Stackenwalt suffered critical injuries in an improvised explosive device attack in September of 2009; and

    WHEREAS, he endured dozens of surgeries to repair damage to his spine, arm, and legs and underwent months of therapy to regain cognitive and physical function in the wake of horrific injury; and

    WHEREAS, Branden has since conducted himself in a manner of humble courage and effervescent positivity that is an inspiration and comforting encouragement to military veterans and civilians alike; and

    WHEREAS, Branden's unique experience, perspective and knowledge of post-military adjustment, and physical struggle after being injured in battle represents a skillset of compassionate wisdom and genuine empathy that cannot be duplicated by any academic degree, graduate, undergraduate, or otherwise; and

    WHEREAS, Branden's special abilities of communication and kindness are a unique resource that cannot be emulated in the clinical or mental health armatures of the Veteran's Administration system of care alone; and

    WHEREAS, Branden has expressed a continual desire to be of ongoing service and assistance to his nation, his state, and his fellow soldiers; and

    WHEREAS, our nation suffers the peacetime loss of dozens of servicemen and women each year by suicide when they become overwhelmed by the unseen scars to mind and heart; and

    WHEREAS, our honored veterans routinely exhibit willingness to talk openly of their battlefield experiences and struggles only to fellow veterans with whom they share an irreplaceable bond of common task and trauma; and

    WHEREAS, Branden Stackenwalt has repeatedly shown profound skill and effectiveness in effortlessly communicating a joyful warmth of uplifting human kindness necessary to help suffering soldiers find comfort and support in their times of crisis; and

    WHEREAS, Branden is a priceless example of a soldier willing to help service members and civilians alike to understand the lasting challenges and scars of wartime deployment:
