    WHEREAS, the State of South Dakota has experienced grave consequences from the GEAR UP and EB-5 scandals and has received failing grades from national groups concerning South Dakota state government's susceptibility to corruption, cronyism, and nepotism:

    NOW, THEREFORE, BE IT RESOLVED, by the Senate of the Ninety-Second Legislature of the State of South Dakota, the House of Representatives concurring therein, that we respectfully request that a special prosecutor be appointed by the South Dakota attorney general to prosecute, both civilly and criminally, all losses that the South Dakota taxpayers have sustained as a result of the above-mentioned scandals.

    HB 1069: FOR AN ACT ENTITLED, An Act to repeal and revise certain provisions related to campaign finance and to declare an emergency.

    Sen. Maher moved that HB 1069 be amended as follows:

    On page 7 of the House engrossed bill, remove the overstrikes from lines 12 to 14, inclusive.

    On page 7, line 15, remove the overstrikes from "(16)".

    On page 39, between lines 22 and 23, insert:

"    Section 35. That chapter 12-27 be amended by adding a NEW SECTION to read:

    No provision of this Act may be construed to prohibit nor deny from the people any right, privilege, or responsibility that is reserved to them in the Constitution of this state. The Legislature finds and declares that accountability to the people is of paramount importance to the inherent stability and preservation of the integrity of South Dakota's political system. The provisions of this Act shall prevent corruption or any appearance of corruption through active participation by citizens who believe that their role in the state's political system is insignificant. No enforcement of any provision of this Act shall be intended to deny any citizen the active participation in any campaign.".

    Sen. Curd requested that Joint Rule 5-17 be invoked on HB 1069.

    Which request was supported and HB 1069 with Sen. Maher's pending motion to amend was deferred until Wednesday, February 1st, the 14th legislative day.
