    The Committee on Commerce and Energy respectfully reports that it has had under consideration SB 101 and returns the same with the recommendation that said bill be amended as follows:

    On the printed bill, delete everything after the enacting clause and insert:

    "Section 1. Any health benefit plan as defined in § 58-17H-2 that provides benefits for injected or intravenously administered cancer treatment medication used to kill or slow the growth of cancerous cells shall provide no less favorable benefits for prescribed, orally administered anticancer medication covered by the plan, regardless of the formulation or benefit category determination by the health plan.

    Section 2. A health carrier may not reclassify benefits with respect to cancer treatment medications or increase a copayment, deductible, or coinsurance amount for covered cancer treatment medications that are injected or intravenously administered unless:

            (1)    The increase is applied generally to other medical or pharmaceutical benefits covered under the plan and is not done to circumvent section 1 of this Act;

            (2)    The reclassification of benefits with respect to cancer treatment medications is done in a manner that is consistent with this Act;

            (3)    There are significant increases in utilization of cancer treatment medications; or

            (4)    A health carrier is applying cost-sharing increases consistent with the annual increases in the cost of health care.

    Section 3. Nothing in this Act prohibits a health carrier from performing medical management practices that comply with the provisions of chapter 58-17H."

    HB 1111: FOR AN ACT ENTITLED, An Act to increase the costs and expenses considered reasonable for the collection of certain dishonored checks.

    HB 1132: FOR AN ACT ENTITLED, An Act to revise certain provisions regarding the titling of motor vehicles, boats, mobile homes, and manufactured homes and the issuance of temporary permits by licensed dealers.

    HJR 1001: A JOINT RESOLUTION, Making formal application to Congress to call an Article V convention of the states for the sole purpose of proposing a federal balanced budget amendment.

    And signed the same in the presence of the Senate.

COMMEMORATION

    SC 18 Introduced by: Senator Holien and Representatives Zikmund, Mickelson, and Solum

        A LEGISLATIVE COMMEMORATION, Honoring the memory of Emmett Bendix "Ike" Oleson for his life-long dedication to education.

    WHEREAS, in 1965, E.B. "Ike" Oleson helped craft House Bill 668, which created the South Dakota Division of Vocational Education. Then, on March 29, 1965, Governor Nils Boe appointed Oleson to be the state's first Director of Vocational Education; and

    WHEREAS, given only a few months to implement a statewide plan for vocational education, "Ike" Oleson drafted a budget, secured funding, approved curriculum, hired staff, designated schools, and approved tuition rates; and

    WHEREAS, "Ike" Oleson established six post-secondary vocational schools in South Dakota, of which four are still in existence today. Oleson set the goals of vocational education

as being dedicated to helping people acquire job skills to become employable and productive citizens. Those goals are still the guiding force in South Dakota's vocational schools. Believing that people learned best by doing, Oleson also started on-the-job training as a component of vocational education; and

    WHEREAS, "Ike" Oleson was instrumental in creating multi-district schools in South Dakota, served as Director of Vocational Education until 1975:

    NOW, THEREFORE, BE IT COMMEMORATED, by the Ninetieth Legislature of the State of South Dakota, that "Ike" Oleson's legacy lives on in the thousands of lives that were improved because of the education they received in South Dakota's vocational institutes, and in the robust South Dakota economy that benefitted greatly from skilled workers, and in the continuing success of the state's technical institutes.

    Sen. Buhl O'Donnell moved that the Senate do now adjourn, which motion prevailed and at 4:23 p.m. the Senate adjourned.
