    HB 1105: FOR AN ACT ENTITLED, An Act to provide for an affidavit creating a rebuttable presumption that a person is not an employee for purposes of workers' compensation and to provide a penalty therefor.

    Rep. Hawley moved that HB 1105 be amended as follows:

    On page 2, between lines 6 and 7 of the House Commerce and Energy Committee engrossed bill, insert:

"    The affidavit of exempt status shall contain substantially the following:

            (1)    Statements that the affiant:

            (a)    Is not an employee and does not want a workers' compensation insurance policy;
            (b)    Has read, signed, and understands the exempt status fact sheet attachment to the affidavit;
            (c)    Understands that the affiant will be considered an independent contractor and will not be considered an employee under the South Dakota Workers' Compensation Law;
            (d)    Understands that the affiant will not be eligible for compensation under the South Dakota Workers' Compensation Law;
            (e)    Understands that the signing of the affidavit creates a rebuttable presumption that the affiant is not an employee for the purpose of the South Dakota Workers' Compensation Act;
            (f)    Understands that the signing of the affidavit does not affect the rights or coverage of any employee of the affiant;
            (g)    Is not signing the affidavit or providing information as a result of force, threat, coercion, compulsion, or duress; and
            (h)    Understands that knowingly providing false information on an affidavit of exempt status under the South Dakota Workers' Compensation Law is a Class 2 misdemeanor; and

            (2)    An exempt status fact sheet, to be attached to the affidavit, which:

            (a)    Delineates the legal requirements recognized in law for determining whether a person is an independent contractor; and
            (b)    Contains a statement that the affiant believes they are an independent contractor given the preceding list of legal requirements.".

    On page 2, line 9, delete "knowingly" and insert "solicits or"

    On page 2, line 10, after "Law" insert "with actual knowledge".

        A LEGISLATIVE COMMEMORATION, Honoring and commending the 2014 Gregory High School Football Team.

    WHEREAS, the 2014 Gregory Gorillas football team finished the 2014 season with a 12-0 record; and

    WHEREAS, the Gregory Gorillas football team defeated the Woonsocket-Wessington Springs-Sanborn Central Blackhawks 31-8 in the 9AA championship game, finalizing an impressive playoff run; and

    WHEREAS, the Gregory Gorillas football team has been a dominating force in South Dakota high school football with appearances in the state playoffs during the years of 1981, 1984, 1996, 1997, 2001, and 2003 in the 11-man class, earning runner-up titles and a state championship title in 1998; and

    WHEREAS, the Gregory Gorillas football team has continued its momentum in the 9-man class with playoff appearances in 2007, earning the runner-up title and in 2014, capturing the state championship title:

    NOW, THEREFORE, BE IT COMMEMORATED, by the Ninetieth Legislature of the State of South Dakota, that the South Dakota Legislature commends the Gregory High School Football Team for winning the state 9AA championship, and seniors Kurt Braun, Jonah Beck, Mitchel Klundt, Brandon Warnke, Dowain Kerner, Damon Eagle Star, Cole Carter, Gavin Thomas, Mason Juracek, Lukas Kirkely of Denmark, Fabio Stocker of Germany, student manager Dustin Soesbe, and cheerleader Kristen Holmberg, and head coach Brian Allmendinger and all of the team's coaching staff, managers, cheerleaders, volunteers, and fans be commended for their outstanding efforts in the 2014 season.
