An Act to
require
certain firefighting equipment purchased by a fire department contain
particular labelingallow
the purchasing of certain firefighting equipment by a fire department
to contain particular labeling.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That a NEW SECTION be added to chapter 34-31:
A
fire department in this state may
only
purchase firefighting personal protective equipment that has a
permanently affixed label indicating whether the equipment contains a
perfluoroalkyl or polyfluoroalkyl substance.
For the purposes of this section, "firefighting personal protective equipment" means coats, coveralls, footwear, gloves, helmets, hoods, trousers, and any other clothing designed or intended to be worn by firefighting personnel during fire and rescue activities.
Section 2. This Act is effective beginning July 1, 2026.
