AMENDMENT 16A
FOR THE INTRODUCED BILL

An Act to set aside certain contractor's excise tax collections relating to the Ellsworth Air Force Base, to create a fund for the collections, and to provide an appropriation therefor.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That a NEW SECTION be added to chapter 1-16J:
There
is created in the state treasury the South Dakota Ellsworth
Development Authority support fund. The fund consists of
all
taxes collected in accordance with section 2 of this Act. Interest
on moneys credited to the fund must remain in the fund.
The authority shall administer the fund. The authority may award grant moneys from the fund as needed to achieve the purposes of the fund.
The authority shall report annually to the special committee created in § 4-8A-2, the following for each grant made from the fund:
(1) The name of the recipient and the amount of the grant;
(2) The purpose for and project supported by the grant; and
(3) An explanation for how the grant will support Ellsworth Air Force Base.
Moneys in the fund are continuously appropriated for mitigating the impacts of expanding the mission of the base as well as to support the mission and troops stationed at Ellsworth Air Force Base.
Section 2. That a NEW SECTION be added to chapter 10-46A:
The One-half
of the excise
tax collected under chapter 10-46A
from projects on Ellsworth Air Force Base must be deposited into the
South Dakota Ellsworth Development Authority support fund, created in
section 1 of this Act.
One-half of the excise tax collected under chapter 10-46A from projects on Ellsworth Air Force Base must be deposited into the general fund.
