An Act to require the acceptance of a cash payment for admission to a school-affiliated event.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That a NEW SECTION be added to chapter 13-1:
Every qualifying school must accept a cash payment for admission to a school-affiliated event, if the cost of admission is less than or equal to one thousand dollars. If a qualifying school refuses to accept a cash payment from an individual for admission to a school-affiliated event on the day of the event, and if the individual demonstrates that the individual has an amount of cash sufficient to pay for the admission fee, the qualifying school must grant the individual admission to the event without charge.
Every qualifying school that offers concessions for sale at a school-affiliated event must provide at least one location on each floor at which concessions are sold, where an individual may pay cash for concessions.
For the purposes of this section, "cash" means any physical coin, currency, or note that is designated as legal tender by federal law.
For
the purposes of this section, "qualifying school" means any
school district,
department-accredited
accredited nonpublic school, and institution under the control of the
South Dakota Board of Regents or the South Dakota Board of Technical
Education.
For the purpose of this section, "school-affiliated event" means:
(1) Any
athletic competition, play, musical, concert, performance, or other
activity
that is conducted:
(a) That
is conducted or sponsored by the qualifying school for which the
qualifying school charges an admission fee
to attend;
or
(b) In which a qualifying school participates and for which an admission fee is charged; or
(2) Any event or activity that is conducted in a facility that is owned or leased by a qualifying school.
