     "      Section 1. That chapter 24-15A be amended by adding thereto a NEW SECTION to read as follows:

     If a person receives a suspended imposition of sentence for an offense committed on or after July 1, 2008, and that offense constitutes a felony under the laws of the state, any other state, or the United States at the time of the suspension of imposition, that offense, whether or not discharge and dismissal have occurred, shall be considered a prior felony conviction for

purposes of establishment of an initial parole date pursuant to this chapter. The date of the first order suspending the imposition of sentence, whether or not discharge and dismissal have occurred, shall be the date of conviction for purposes of establishment of an initial parole date pursuant to this chapter."


    And that as so amended said bill do pass.

         A CONCURRENT RESOLUTION,  Encouraging the use of sunscreen and discouraging young persons from using tanning devices.

     WHEREAS,  the American Academy of Dermatology is concerned with the growing trends in the development and incidence of skin cancer; and

     WHEREAS,  radiation from artificial sources, such as tanning beds, is a known human carcinogen; and

     WHEREAS,  ultraviolet radiation from indoor tanning devices can be up to fifteen times greater than what one would be exposed to through moderate outdoor sun exposure; and

     WHEREAS,  one in five Americans will develop some form of skin cancer during their lifetime and one American dies every sixty-five minutes from melanoma, the deadliest form of skin cancer; and

     WHEREAS,  the incidence of melanoma has increased six hundred ninety percent from 1950 to 2001; and

     WHEREAS,  skin damage from ultraviolet radiation is cumulative, and its adverse effects, skin cancer and premature aging, often take years to become apparent; and

     WHEREAS,  much of this damage occurs during the teenage years as evidenced by the fact that skin cancer is occurring in younger populations:

     NOW, THEREFORE, BE IT RESOLVED,  by the House of Representatives of the Eighty- Third Legislature of the State of South Dakota, the Senate concurring therein, that the Legislature recommends that everyone use sunscreen when participating in outdoor activities; and

     BE IT FURTHER RESOLVED,  that the Legislature urges all parents to be aware of the known health hazards of intentional cosmetic tanning of the skin and recommends that parents encourage their teenagers to restrict their use of tanning devices to decrease the staggering increase in the incidence of melanoma in young people.

     Was read the first time and the Speaker waived the committee referral.

     Rep. Hunt moved that the Committee on Health and Human Services be instructed to deliver HB 1155 to the floor of the House, pursuant to Joint Rule 7-7.

         A LEGISLATIVE COMMEMORATION,  Honoring Brittany Davis of Waubay as the 2008 South Dakota Snow Queen.

     WHEREAS,  Brittany Davis, a senior at Waubay High School, was chosen as the 2008 South Dakota Snow Queen; and

     WHEREAS,  Brittany has distinguished herself by showing her capacity as a leader in her position as president of the Waubay FFA chapter and other community activities; and

     WHEREAS,  Brittany has proven her devotion to her school through her role as homecoming queen and her involvement in such activities as cheerleading, basketball, and volleyball; and

     WHEREAS,  Brittany participates in a number of extracurricular activities including Girl Scouts, theater, FFA, National Honor Society, and 4-H:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eighty-Third Legislature of the State of South Dakota, that Brittany Davis be congratulated upon her selection as the 2008 South Dakota Snow Queen.
