AMENDMENT 1204B FOR THE HOUSE HEALTH AND HUMAN SERVICES ENGROSSED BILL

An Act to reimburse adoptive parents for certain costs incurred in the provision of medical services.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 25-6 be amended with a NEW SECTION:

The Department of Social Services shall reimburse an eligible parent for charges incurred, on or after July 1, 2023, in the provision of medical services to a child who was adopted by the parent in accordance with this chapter.

The amount reimbursable under this section is the difference between the amount billed by the medical services provider and the amount covered by any healthcare insurance available to the parent.

Terms used in this section mean:

(1) "Eligible parent," a parent who has resided in this state for at least twelve months prior to the date of a reimbursable service; and

(2) "Medical services, those services listed in the state Medicaid plan.

The reimbursement provided for in this section is not applicable in the case of a child adopted by the child's stepparent, or in the case of a child who has reached the age of eighteen.

The department shall, by rules promulgated in accordance with chapter 1-26, established the time and manner in which a reimbursement may be requested.

Section 2. The funding necessary for reimbursements under section 1 of this Act must be budgeted and expended through the general appropriations act, pursuant to chapter 4-7.
