AMENDMENT 198F FOR THE HOUSE STATE AFFAIRS

An Act to
establish
an interim juvenile
continuum of care committee
regarding
alternatives for placement of juvenile offenders.
Be it enacted by the Legislature of the State of South Dakota:
Section 1.
An
interim juvenile placement
continuum
of care committee is established to consider and develop alternatives
for placement community
based alternative programing that best meets the needs of identified
juveniles or juvenile offenders within the community, develop
findings, report on the findings, and
recommend any necessary legislation. The
speaker shall appoint five members of the House of Representatives
and three members of the public, at least two with involvement in
public education. The president pro tempore shall appoint five
members of the Senate and three members of the public, at least two
with involvement in public education. The Governor shall appoint
eight individuals.
The committee must consist of:
(1) Four members of the House of Representatives, appointed by the speaker of the House of Representatives;
(2) Four members of the Senate, appointed by the president pro tempore of the Senate;
(3) Two administrators employed by school districts, appointed by the speaker of the House of Representatives;
(4) Two administrators employed by school districts, appointed by the president pro tempore of the Senate;
(5) One mental health professional employed in the private sector, appointed by the speaker of the House of Representatives;
(6) One mental health professional employed in the private sector, appointed by the president pro tempore of the Senate;
(7) One addiction and prevention professional who is employed in the private sector and provides services primarily to juveniles, appointed by the speaker of the House of Representatives;
(8) One addiction and prevention professional who is employed in the private sector and provides services primarily to juveniles, appointed by the president pro tempore of the Senate;
(9) One person representing law enforcement, appointed by the speaker of the House of Representatives;
(10) One person representing law enforcement, appointed by the president pro tempore of the Senate; and
(9) Two persons representing the South Dakota Unified Judicial System, appointed by the Chief Justice of the South Dakota Supreme Court.
If there is a vacancy on the committee, the vacancy may be filled in the same manner as the original appointment.
The committee shall be under the supervision of the Executive Board of the Legislative Research Council and staffed and funded as an interim legislative committee.
The committee shall deliver its report and recommended legislation to the Legislature by January 1, 2023.
