Section 4. That chapter 34-23A be amended with a NEW SECTION:
No physician, medical facility, clinic, or other person physically located outside of this state, and no person acting on behalf of another person physically located outside of this state may deliver, mail, prescribe, or send any chemical abortion drug that is intended to terminate the pregnancy of a mother who is physically located in this state at the time the drug is ordered, delivered, or received.
Any person who violates this section is guilty of a Class 4 felony and subject to civil actions, as set forth in §§ 34-23A-60 and 34-23A-61. "
