AMENDMENT 1335B FOR THE INTRODUCED BILL

An Act to revise certain provisions regarding the expenditure of moneys allotted to the state by the United States of America.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That § 4-8-17 be AMENDED:

4-8-17. The Governor is authorized and empowered to accept on behalf of the state any appropriations made or moneys allotted to the state by the United States of America, as well as the provisions of any act of Congress appropriating or allotting such funds to the state to be used in cooperation with departments of the federal government and appropriations and acts of Congress.

The funds received for the State of South Dakota pursuant to the provisions of this section shall be administered and expended under the immediate supervision of the Governor through such state departments as he the Governor shall designate for that purpose, and shall be deposited in the state treasury to be paid out by warrants drawn by the state auditor on vouchers approved by the Governor. The expenditure of moneys pursuant to this section may only occur after the moneys have been appropriated pursuant to § 4-8B-10.

Section 2. That § 4-8B-10 be AMENDED:

4-8B-10. Notwithstanding § 4-8-17, moneys Moneys and grants received from the United States, pursuant to § 4-8-17 or other grants or gifts of other funds in excess of the amounts appropriated in the general appropriations act or special appropriation acts for capital projects, shall not be deemed appropriated until after review by must first be reviewed and approved by the special committee created by chapter 4-8A before the moneys may be appropriated for expenditure. The appropriation request must contain the specific purposes for which the appropriation is to be used and the amount requested. and then only with With an affirmative vote on acceptance of such funds by a majority of the full membership of the special committee to appropriate the sum of money requested, the money is appropriated to the requesting entity. Subsequent to an affirmative action on the part of the special committee by the special committee to appropriate a sum of money pursuant to this section, the Bureau of Finance and Management shall make the appropriate changes in the budgetary accounting system to reflect the appropriation approved by the special committee. The two houses of the Legislature may establish rules for the interpretation of this section through adoption of joint rules.
