An Act to establish the fundamental right of a parent.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 1-1A be amended with a NEW SECTION:

The fundamental right to make decisions concerning the upbringing, education, and care of a child rests with the parents or court appointed guardian of the child. No state agency, political subdivision, or any elected or appointed official or employee of this state or its political subdivisions may abridge or encroach upon that fundamental right.
