AMENDMENT 102B FOR THE INTRODUCED BILL

An Act to create the medicaid expansion fund and to provide for the receipt of monies received as a result of expanding medicaid eligibility.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That chapter 28-6 be amended with a NEW SECTION:
There is
established in the state treasury the medicaid expansion fund. Any
moneys received
from the federal government through general
fund savings realized from a temporary increase in the federal
medical assistance percentage, as authorized by the American Rescue
Plan Act of 2021, Public Law 117–2, § 9814,
as a result of medicaid expansion, must be deposited into the fund.
Expenditures out of the medicaid expansion fund must only be by
special
appropriation
of the Legislature and must be used to cover current and future
medicaid costs.
Interest earned on money in the fund must be deposited into the fund.
Section 2. That chapter 28-6 be amended with a NEW SECTION:
For the purposes of section 1 of this Act, the term, medicaid expansion, means the act by which, whether by the passage of a statewide ballot measure or an act of the Legislature, eligibility for medicaid benefits is expanded to include any person over age eighteen and under age sixty-five whose income is at or below one hundred thirty-three percent of the federal poverty level adjusted for the applicable family size, as authorized by 42 U.S.C. § 1396a as of March 11, 2021.
