An Act to establish a restaurant meals program as part of the supplemental nutrition assistance program.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That chapter 28-12 be amended with a NEW SECTION:

The Department of Social Services shall establish a restaurant meals program as part of the supplemental nutrition assistance program. An eligible household may, in accordance with 7 U.S.C. § 2012(k), as of December 20, 2018, redeem benefits at a private establishment that contracts with the department to offer meals for eligible individuals at concessional prices subject to 7 U.S.C. § 2018(h), as of December 27, 2020.

For the purposes of this section, the term, eligible household, means a household, as defined in 7 U.S.C. § 2012, as of October 19, 2021, occupied by:

(1) An elderly or disabled member, as defined in 7 U.S.C. § 2012(j), as of December 20, 2018; or

(2) A homeless individual, as defined in 7 U.S.C. § 2012(l), as of December 20, 2018.

Section 2. That § 28-12-1 be AMENDED:

28-12-1. The Department of Social Services may enter into agreements and contracts with the United States federal government and its agencies and with the political subdivisions of this state for the purpose of participating in The Food Stamp Act of 1964 (P.L. 88-525) and any related acts, as amended to January 1, 2004 December 27, 2020. The secretary of social services shall promulgate reasonable and necessary rules, pursuant to chapter 1-26, as required by the federal government for the administration of the food stamp supplemental nutrition assistance program in South Dakota. Such rules shall be in accordance with federal regulations implementing The Food Stamp Act of 1964, as amended to January 1, 2004 December 27, 2020.
