AMENDMENT 35C FOR THE INTRODUCED BILL

An Act to make an appropriation to implement provisions concerning the legalization, regulation, and taxation of marijuana, and to declare an emergency.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. There is hereby appropriated from the general fund the total sum of $4,026,253 $4,161,502 to the Department of Revenue and the Department of Health, for purposes of implementing the constitutional provisions contained in Amendment A, related to the legalization, regulation, and taxation of marijuana, and Initiated Measure 26, related to the legalization of marijuana for medical use, approved by the voters during the 2020 general election, related to the legalization, regulation, and taxation of marijuana.

Section 2. There is hereby appropriated from the general fund the sum of $135,249 to the Department of Health for purposes of implementing the provisions contained in Initiated Measure 26, approved by the voters during the 2020 general election, related to the legalization of marijuana for medical use.

Section 2. The secretary of the Department of Revenue shall approve vouchers and the state auditor shall draw warrants to pay expenditures authorized in section 1 of this Act related to the Department of Revenue.

Section 3. The secretary of the Department of Health shall approve vouchers and the state auditor shall draw warrants to pay expenditures authorized in section 2 1 of this Act related to the Department of Health.

Section 4. Any amounts appropriated in this Act not lawfully expended or obligated shall revert in accordance with the procedures prescribed in chapter 4-8.

Section 5. Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
