AMENDMENT 1229A FOR THE INTRODUCED BILL

An Act to establish fees for information provided from the statewide voter registration file.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That a NEW SECTION be added:
12-4-37.1 Statewide voter registration file--Fees for electronic copies.
The fees for obtaining a copy of an electronic file with voter registration information are as follows:
(1) Statewide
complete file,
five
one thousand two hundred fifty dollars;
(2) Statewide complete file for new parties or parties with alternative political status for just their party voters:
(a) Ten dollars for one thousand names or less;
(b) Twenty-five dollars for one thousand one to ten thousand names, inclusive;
(c) Fifty dollars for ten thousand one to twenty-five thousand names, inclusive; and
(d) One hundred twenty-five dollars for more than twenty-five thousand names;
(3) Legislative
district complete file,
twenty-five
fifty dollars;
(4) County or any other district complete file:
(a) Five
Ten dollars for one thousand names or less;
(b) Fifteen
Twenty-five dollars for one thousand one to ten thousand names,
inclusive;
(c) Twenty-five
Fifty dollars for ten thousand one to twenty-five thousand names,
inclusive; and
(d) Fifty
One hundred twenty-five dollars for more than twenty-five thousand
names;
(5) Any updated partial file that contains only changes made within a year after the purchase of a complete file:
(a) Fifty
One hundred twenty-five dollars for a statewide partial file; and
(b) Ten
Fifteen dollars for a legislative district, any other district, or
county partial file.
Section 2. That a NEW SECTION be added:
12-4-37.2 Statewide voter registration file--Fees for paper lists.
The fees for obtaining a paper list with voter registration information are as follows:
(1) Statewide
complete list, one
five thousand five hundred dollars;
(2) Statewide complete list for new parties or parties with alternative political status for just their party voters:
(a) Ten
Twenty dollars for one thousand names or less;
(b) Thirty
Seventy-five dollars for one thousand one to ten thousand names,
inclusive;
(c) One
Two hundred dollars for ten thousand one to twenty-five thousand
names, inclusive; and
(d) Two
Six hundred fifty
dollars for more than twenty-five thousand names;
(3) Legislative
district complete list,
seventy-five
two hundred dollars;
(4) County or any other district complete list:
(a) Fifteen
Twenty dollars for one thousand names or less;
(b) Forty-five
Seventy-five dollars for one thousand one to ten thousand names,
inclusive;
(c) Seventy-five
Two hundred dollars for ten thousand one to twenty-five thousand
names, inclusive; and
(d) One
Six hundred fifty
dollars for more than twenty-five thousand names;
(5) Any updated partial list that contains only changes made within a year after the purchase of a complete list:
(a) One
Five hundred fifty dollars for a statewide partial list; and
(b) Thirty
Sixty dollars for a legislative district, any other district, or
county partial list.
Section 3. That a NEW SECTION be added:
12-4-37.3. Statewide voter registration file--Fees for absentee voter information.
The fees for obtaining a copy of an electronic file with daily absentee voter registration information per election are as follows:
(1) Statewide
complete file,
seven
one thousand five hundred
fifty
dollars;
(2) Legislative
district complete file,
forty
seventy-five dollars; and
(3) County complete file:
(a) Fifteen
Thirty-five dollars for one thousand names or less;
(b) Twenty-five
Fifty dollars for
one thousand one to ten thousand names, inclusive;
(c) Forty
Seventy-five dollars for ten thousand one to twenty-five thousand
names, inclusive; and
(d) Seventy-five
One hundred fifty dollars for more than twenty-five thousand names.
Section 4. That § 12-4-39 be AMENDED.
12-4-39. Promulgation of rules--Scope.
The secretary of state may promulgate rules pursuant to chapter 1-26 concerning:
(1) Procedures for the establishing the statewide voter registration file;
(2) Transmission of the voter registration information from the county to the Office of the Secretary of State;
(3) Procedures for determining duplicate voter registration; and
(4) Dissemination of the
information from the statewide voter registration file;
and
(5) Establishment
of fees for information provided from the statewide voter
registration file.
