AMENDMENT 1054D FOR THE INTRODUCED BILL

An Act to require a copy of any initiated measure or amendment on the ballot be provided to voters.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That § 12-13-11 be AMENDED.

12-13-11. Materials printed on ballot--Full text of measure included--Sponsor's cost--Separate ballot.

The title, explanation, recitation, place for voting, and statement as required by this chapter shall be printed on the ballot in lieu of the. A copy of the law, measure, constitutional amendment, or other question to be submitted to a vote of the people in its entirety, whether reusable or single use, shall be given to each voter made available to each voter at the polls, along with the ballot. There shall be at least one copy per voting booth at each poll site. The sponsoring organization of the initiated measure or initiated amendment state shall be responsible for the cost of all copies provided to the voters, including the cost of any necessary postage. All proposed constitutional amendments to be submitted at an election shall be placed on one ballot and all initiated measures or referred laws upon a separate ballot. The failure to make a copy of a law, measure, constitutional amendment, or other question available under this section shall not be grounds to invalidate otherwise lawfully cast ballots.
