    The House convened at 1:00 p.m., pursuant to adjournment, the Speaker presiding.

    The prayer was offered by the Chaplain, Larry Cass, followed by the Pledge of Allegiance led by House pages Michala Jones, Brittany Knutson, and Melaney Maag.

    The Committee on Health and Human Services respectfully reports that it has had under consideration HB 1061 and returns the same with the recommendation that said bill be amended as follows:

    On page 5 of the printed bill, delete lines 3 and 4, and insert:

"    Section 13. No licensed health care provider or hospital or agent thereof is liable for any injury which directly or indirectly arises out of, or is the result of, an act or omission by a registered midwife.".

    On page 4, between lines 22 and 23 of the printed bill, insert:

"    The registered midwife shall provide the client's health records to the hospital identified in the transport plan at least one month prior to the expected delivery date. However, no client health records may be transmitted unless the client has provided specific consent permitting the midwife to share the client's health records with the hospital in compliance with this section and

with relevant federal and state patient privacy laws. A copy of the signed consent shall be transmitted to the hospital with the health records. If consent is not granted by the client, the midwife shall notify the hospital that the hospital is included in a home birth transport plan and identify the estimated due date. In any event, if there is no transport, the registered midwife shall notify the hospital within one week after delivery.".


    And that as so amended said bill do pass.

    WHEREAS, the above named served loyally as pages for the House of Representatives of the Eighty-sixth Legislative Session; and

        A CONCURRENT RESOLUTION, Making certain legislative findings about the constitutionality of the federal health care system.

    WHEREAS, the Legislature finds that no authority exists in the United States Constitution to justify the enactment of any federal statute which interferes with the right of any person or entity to choose their personal physician, private health care system, or private health care coverage; and

    WHEREAS, the Legislature further finds that no authority exists in the United States Constitution to justify the enactment of any federal statute which imposes any penalty, tax, fee, or fine, of any type, for declining to purchase health care coverage or participate in any particular health care system or plan:

    NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the Eighty-sixth Legislature of the State of South Dakota, the Senate concurring therein, the Legislature finds that in the absence of such specific authority, and in conjunction with the unenumerated and reserved powers retained by the people and the states pursuant to the ninth and tenth amendments, all such federal legislation is inherently unconstitutional.
