SB 125: allow school districts to share academic programs and facilities.

MOTION:     AMEND SB 125

On the printed bill, delete everything after the enacting clause and insert:

"      Section 1. That chapter 13-15 be amended by adding thereto a NEW SECTION to read as follows:

     The provisions of §  13-15-26 do not apply to any school district sharing academic programs and facilities pursuant to § 13-15-1.3 provided that the district offers an elementary or secondary instructional program within the boundaries of the district.

     Section 2. That chapter 13-15 be amended by adding thereto a NEW SECTION to read as follows:

     Compliance of section 1 of this Act shall satisfy the requirements of §  13-5-1 if the school district does not fall below the minimum fall enrollment requirements established in §  13-6-97."

In the previously adopted amendment (125ca), delete Section 2 and insert:

"

     Section 2. Any school district sharing academic programs and facilities pursuant to section 1 of this Act meets the requirements established in §  13-5-1 if the school district does not fall below the minimum fall enrollment requirements established in §  13-6-97. ".
