The two hundred twentieth meeting of the Rules Review Committee was called to order via telephone conference by Chair Representative Orville Smidt at 9:00 a.m., May 8, 2001, in Room 413 of the State Capitol, Pierre, South Dakota.
A quorum was determined with the following members answering the roll call: Senators Eric Bogue, H. Paul Dennert, and Royal "Mac" McCracken; and Representatives Matthew Michels and Orville Smidt. Representative Gerald Lange was excused. Others participating in the meeting were Randy Moses, Department of Commerce and Regulation: Division of Insurance and Jill Wellhouse, Department of Social Services.
Staff members present included Doug Decker, Code Counsel, and Phyllis Petersen, Senior Legislative Secretary.
All material distributed at the meeting is attached to the original minutes on file in the Legislative Research Council. For the purpose of continuity, these minutes are not necessarily in chronological order.
Approval of Minutes
Senator Dennert noted that the following change should be made to the minutes of the previous meeting. On the last page, third paragraph from the end, delete "May 18" and insert "May 8". Senator Dennert moved, seconded by Senator McCracken, that the minutes of the April 17, 2001, meeting be approved as corrected. Motion prevailed on a roll call vote. Those voting aye: Bogue, Dennert, McCracken, Michels, and Smidt. Excused: Lange.
Rules Reviewed
Department of Commerce and Regulation: Division of Insurance
? Privacy of personal nonpublic financial information.Mr. Randy Moses summarized the rules which put into effect the requirements of Title V of the Gramm-Leach-Bliley Act relating to privacy of personal nonpublic financial information.
A motion was made by Representative Smidt, seconded by Representative Michels, to approve the Division of Insurance rules. Motion prevailed on a roll call vote. Those voting aye: Bogue, Dennert, McCracken, Michels, and Smidt. Excused: Lange.
Department of Social Services ? Child Protection Services ? family foster homes, group care centers for minors, residential treatment centers, child placement agencies, environmental health standards, maternity homes, and adult foster care.
Ms. Jill Wellhouse reviewed the Child Protection Services rules.
A motion was made by Senator McCracken, seconded by Representative Michels, to approve the rules proposed by the Department of Social Services. Motion prevailed on a roll call vote. Those voting aye: Bogue, Dennert, McCracken, Michels, and Smidt. Excused: Lange.
Representative Michels moved, seconded by Senator Bogue, that the committee adjourn. Motion prevailed on a roll call vote. Those voting aye: Bogue, Dennert, McCracken, Michels, and Smidt. Excused: Lange.
The committee adjourned at 9:30 a.m.
