    13-42-9. The secretary of the Department of Education may revoke or suspend any certificate for any cause which would have prevented its issue, plain violation of contract, gross immorality, incompetency, violation of the code of ethics in effect on July 1, 2001, established pursuant to § 13-43-25 or 13-43-45, as determined by the Professional Teachers Practices and Standards Commission or the Professional Administrators Practices and Standards Commission, or flagrant neglect of duty, and may suspend any certificate for a period not to exceed one year for breaking or jumping a contract, if such suspension is requested by the school board. However, the secretary may not suspend a certificate for breaking or jumping a contract if the school board collected liquidated damages pursuant to the terms of the contract. "

    "Section 2. That § 32-17-25 be amended to read as follows:

    32-17-25. Every Each bicycle shall be equipped with a lighted lamp on the front thereof visible under normal atmospheric conditions from a distance of at least three hundred feet in front of such the bicycle and shall also be equipped with a reflex reflective mirror or, lamp, or other material on the rear exhibiting a yellow or red light visible under like conditions from a distance of at least two hundred feet to the rear of such the bicycle. Any person riding a bicycle

shall also use reflective material on the person's clothing. A violation of this section is a petty offense. "

    SB 155: FOR AN ACT ENTITLED, An Act to provide for the promulgation and adoption of administrative rules with a substantial financial impact upon political subdivisions of state government.

    On the Senate Local Government Committee engrossed bill, delete everything after the enacting clause and insert:

    "Section 1. That § 1-26-4.7 be amended to read as follows:

    1-26-4.7. The Interim Rules Review Committee may require an agency to revert to any step in the adoption procedure provided in § 1-26-4. The Interim Rules Review Committee may require an agency to hold public hearings in addition to those provided for in § 1-26-4 if, in the judgment of the committee:

            (1)    The substance of the proposed rule has been significantly rewritten from the originally proposed rule which was not the result of testimony received from the public hearing;

            (2)    The proposed rule needs to be significantly rewritten in order to accomplish the intent of the agency;

            (3)    The proposed rule needs to be rewritten to address the recommendations or objections of the Interim Rules Review Committee;

            (4)    The proposed rule is not a valid exercise of delegated legislative authority;

            (5)    The proposed rule is not in proper form;

            (6)    The notice given prior to the proposed rule's adoption was not sufficient to give adequate notice to persons likely to be affected by the proposed rule;

            (7)    The proposed rule is not consistent with the expressed legislative intent pertaining to the specific provision of law which the proposed rule implements; or

            (8)    The proposed rule is not a reasonable implementation of the law as it affects the convenience of the general public or persons likely affected by the proposed rule.

    The Interim Rules Review Committee shall consider whether any rule complies with the provisions of § 6-15-1. If the committee determines that any proposed rule does not comply with § 6-15-1, the committee shall require an agency to revert to any step in the adoption procedure provided in § 1-26-4.

    If the committee requires an agency to revert to any step in the adoption procedure pursuant to this section, the time limitations set by chapter 1-26 shall also revert to the same step. "

    35-4-122. Any person, corporation, or business entity that is issued a new retail license under subdivision 35-4-2(3) after June 30, 2009, and derives less than fifty percent of the licensee's annual gross receipts from the sale of alcoholic beverages at the location where the license is held shall sell display its alcoholic beverages, other than malt beverages, in an area which is separated by a physical barrier from the rest of the establishment. For the purposes of this section, a physical barrier includes a wall or fence erected for the sole purpose of separating the area in which the alcoholic beverages are sold displayed from the rest of the establishment. "

    WHEREAS, Dupree was settled by hardy pioneers who answered the call to come to central South Dakota following the Homestead Act of 1908 and was moved to its present site in 1910; and

    WHEREAS, Dupree is rich in ranching, farming, and cultural history, which the residents strive to preserve for future generations; and

    WHEREAS, the centennial will be celebrated at this years's Pioneer Days, July 6 through July 11, 2010; and
