     The Senate convened at 10:00 a.m., pursuant to adjournment, the President presiding.

     The prayer was offered by the Chaplain, Pastor Brad Urbach, followed by the Pledge of Allegiance led by Senate page Jake Brakke.

     Roll Call: All members present.

APPROVAL OF THE JOURNAL


MR. PRESIDENT:

     The Committee on Legislative Procedure respectfully reports that the Secretary of the Senate has had under consideration the Senate Journal of the thirty-seventh day.

     All errors, typographical or otherwise, are duly marked in the temporary journal for correction.

MR. PRESIDENT:

    The Committee on Legislative Procedure respectfully reports that the Office of Engrossing and Enrolling has carefully compared SB 31 and finds the same correctly enrolled.

     The Committee on Legislative Procedure respectfully reports that SB 2, 30, 43, 127, 195, and 207 were delivered to his Excellency, the Governor, for his approval at 10:10 a.m., March 5, 2007.

MESSAGES FROM THE HOUSE


MR. PRESIDENT:

    I have the honor to inform your honorable body that the House has adopted the reports of the Conference Committees on SB 157, 180, and HB 1171.

Also MR. PRESIDENT:

    I have the honor to inform your honorable body that the House has failed to adopt the Report of the Conference Committee on HB 1176 and has appointed Reps. Dykstra, DeVries, and Halverson as a new committee of three on the part of the House to meet with a like committee on the part of the Senate to adjust the differences between the two houses.

     The President announced Sens. Dempster, Gray, and Heidepriem as a committee of three on the part of the Senate to meet with a like committee on the part of the House to adjust the differences between the two houses on HB 1176.

Also MR. PRESIDENT:

    I have the honor to inform your honorable body that the House has passed HB 1174 over the veto of the Governor. The veto message of the Governor is found on page 787 of the House Journal.


    We hereby request your favorable consideration in passing HB 1174, the veto of the Governor notwithstanding.

CONSIDERATION OF EXECUTIVE VETOES AND RECOMMENDATIONS


     Sen. Dempster moved that the veto message of the Governor on HB 1174 be immediately considered.

     Which motion prevailed and the consideration of the veto message of the Governor on HB 1174 was up for immediate consideration.

     The Senate proceeded to the reconsideration of HB 1174 pursuant to the veto of the Governor and the veto message found on page 787 of the House Journal as provided in Article IV, Section 4, of the Constitution of the State of South Dakota.

     The question being "Shall HB 1174 pass, the veto of the Governor notwithstanding?"

     And the roll being called:

     SB 31: FOR AN ACT ENTITLED, An Act to  appropriate money to the Dakota Valley school district.

     SB 180: FOR AN ACT ENTITLED, An Act to  provide for the recognition of certain adoption orders from foreign jurisdictions and to provide for the issuance of birth certificates for certain inter-country adoptions.

     HB 1048: FOR AN ACT ENTITLED, An Act to  reform certain campaign finance requirements and to establish certain fines and penalties.

     HB 1060: FOR AN ACT ENTITLED, An Act to  authorize the Department of Corrections to purchase real property, to make an appropriation therefor, and to declare an emergency.

     HB 1101: FOR AN ACT ENTITLED, An Act to  make an appropriation for maintenance and repair projects of the Board of Regents deemed critical to facility safety and function, and to declare an emergency.

     HB 1131: FOR AN ACT ENTITLED, An Act to  increase the amount of funding for conservation and value-added agriculture purposes from certain unclaimed motor fuel tax refunds.
