Dear Speaker Deadrick and Members of the House:

I herewith return House Bill 1026 with the following recommendations as to STYLE and FORM.

House Bill 1026 is An Act to define unprotected birds.



The title on House Bill 1026 was amended in Senate Agriculture and Natural Resources Committee on February 15, 2007. The motion prevailed by voice vote. A senate engrossed version with the title amendment was never completed nor was there concurrence in the title amendment by the House of Representatives. In essence, even though the title amendment passed, the change in title was never reflected in the enrolled bill.

This problem can be solved by making the following style and form corrections to the House Agriculture and Natural Resources Engrossed Bill as follows:

On page 1, line 1, of the House Agriculture and Natural Resources Committee engrossed bill, delete everything after "An Act to" and insert "classify certain bird species as unprotected."

     SB 30:   FOR AN ACT ENTITLED, An Act to   to make an appropriation for costs related to payments to sparse school districts and to declare an emergency.

     On page 1, line 4 of the printed bill, delete " eight hundred " and insert "three hundred fifty seven thousand two hundred thirteen dollars ($357,213)".

"      Section 3. There is hereby appropriated from the general fund the sum of one million eight hundred thousand dollars ($ 1,800,000 ), or so much thereof as may be necessary, to the Department of Education to be distributed to sparse school districts according to the formula specified in § §  13-13-78 and 13-13-79.".

     Rep. Rhoden moved that SB 173 be amended as follows:

     On page 15, after line 9 of the Housed Taxation Committee engrossed bill, insert:

"
     Section 20. There is hereby established the Senate Bill 173 Implementation and Oversight Advisory Task Force. The task force shall consist of the following eight members:

             (1)    The speaker of the House of Representatives shall appoint four members of the House of Representatives, no more than two of whom may be from one political party; and
             (2)    The president pro tempore of the Senate shall appoint four members of the Senate, no more than two of whom may be from one political party.

     The task force shall advise the department regarding the rules promulgated by the department to administer the provisions of Senate Bill 173 and review the implementation of the provisions of Senate Bill 173 by the Department of Revenue and Regulation.".

     Rep. Hackl moved that SB 173 be further amended as follows:

     On page 15, after line 9 of the House Taxation Committee engrossed bill, insert:

"      Section 20. That chapter 10-6 be amended by adding thereto a NEW SECTION to read as follows:

     If agricultural land is changed to another classification of property, the director of equalization shall determine its deferred value for the previous five years. The deferred value of the property is the difference between the market value of the property, assessed according to its new use, and the assessed value of the property. The director of equalization shall provide these values to the county auditor. The county auditor shall determine the deferred taxes on the property by applying the total property tax levies imposed on the new classification of property for each of the previous three years. The owner of the property at the time the change in property classification occurs shall pay to the county treasurer the deferred taxes on the property. The county auditor shall notify the property owner in writing of the deferred value and the deferred taxes of the property. The owner shall pay the deferred taxes within thirty days of receiving the notice required by this section or before transferring the property, whichever occurs first.

     Section 21. That chapter 10-21 be amended by adding thereto a NEW SECTION to read as follows:

     The county may file a lien with the register of deeds on the property for any deferred taxes owed to the county pursuant to section 20 of this Act. No property on which the county has filed a lien on pursuant to this section may be transferred unless the property taxes are paid in full.

     Section 22. That chapter 10-21 be amended by adding thereto a NEW SECTION to read as follows:

     The owner of the property may appeal the deferred value assigned to the property to the board of county commissioners within thirty days of receiving the notice required by section 20 of this Act.

     Section 23. That chapter 10-21 be amended by adding thereto a NEW SECTION to read as follows:

     Any revenue received by the county from the payment of deferred property taxes pursuant to section 20 of this Act shall be deposited in the county general fund.      Section 1. That § 13-13-10.1 be amended to read as follows:

     13-13-10.1.   Terms used in this chapter mean:

             (1)      "Average daily membership," the average number of resident and nonresident kindergarten through twelfth grade pupils enrolled in all schools operated by the school district during the previous regular school year, minus average number of pupils for whom the district receives tuition, except pupils described in subdivision (1A) and pupils for whom tuition is being paid pursuant to § 13-28-42 and plus the average number of pupils for whom the district pays tuition;
             (1A)      Nonresident students who are in the care and custody of the Department of Social Services, the Unified Judicial System, the Department of Corrections, or other state agencies and are attending a public school may be included in the average daily membership of the receiving district when enrolled in the receiving district. When counting a student who meets these criteria in its general enrollment average daily membership, the receiving district may begin the enrollment on the first day of attendance. The district of residence prior to the custodial transfer may not include students who meet these criteria in its general enrollment average daily membership after the student ceases to attend school in the resident district;
             (2)      "Adjusted average daily membership," calculated as follows:
             (a)      For districts with an average daily membership of two hundred or less, multiply 1.2 times the average daily membership;
             (b)      For districts with an average daily membership of less than six hundred, but greater than two hundred, raise the average daily membership to the 0.8293 power and multiply the result times 2.98;
             (c)      For districts with an average daily membership of six hundred or more, multiply 1.0 times their average daily membership;
             (2A)    "State general fund revenue," all revenue deposited into the state's general fund;
             (3)      "Index factor," is the annual percentage change in the consumer price index for urban wage earners and clerical workers as computed by the Bureau of Labor Statistics of the United States Department of Labor for the year before the year immediately preceding the year of adjustment or three percent, whichever is less four and three- tenths percent, whichever is greater. However, the index factor may not exceed the annual percentage change in the state general fund revenue for the year prior to the year immediately preceding the year of adjustment ;
             (4)      "Per student allocation," for school fiscal year 2006 is $4,237.72. Each school fiscal year thereafter, the per student allocation is the previous fiscal year's per student allocation increased by the index factor;
             (5)      "Local need," the per student allocation multiplied by the adjusted average daily membership;
             (6)      "Local effort," the amount of ad valorem taxes generated in a school fiscal year by applying the levies established pursuant to § 10-12-42;
             (7)      "General fund balance," the unreserved fund balance of the general fund, less general fund exclusions plus, beginning with transfers made in fiscal year 2001, any transfers out of the general fund for the previous school fiscal year;
             (8)      "General fund balance percentage," is a school district's general fund balance divided by the school district's total general fund expenditures for the previous school fiscal year, the quotient expressed as a percent;
             (9)      "General fund base percentage," is the general fund balance percentage as of June 30, 2000. However, the general fund base percentage can never increase and can never be less than twenty percent;
             (10)      "Allowable general fund balance," the fund base percentage multiplied by the district's general fund expenditures in the previous school fiscal year;
             (11)      "Imputed interest rate," the average prime rate for the preceding fiscal year minus 2.5 percentage points;
             (12)      "General fund exclusions," revenue a school district has received from the imposition of the excess tax levy pursuant to § 10-12-43; revenue a school district has received from gifts, contributions, grants, or donations; revenue a school district has received under the provisions of §§ 13-6-92 to 13-6-96, revenue a school district has received as compensation for being a sparse school district under the terms of §§ 13-13-78 and 13-13-79, inclusive; and any revenue in the general fund set aside for a noninsurable judgment.

     Section 2. If a school district's average increase in its mean teacher salary is less than the index factor minus 0.6 percent, the school district's foundation program state aid shall be proportionally reduced. However, the minimum increase in the per student allocation for each school district is three percent or the index factor, whichever is less, and the base year for the calculations is school fiscal year 2007.

     Section 3. There is hereby created the teacher compensation assistance program within the Department of Education to provide funds to school districts for the purpose of assisting them with teacher compensation. The amount of funding available to each school district for this voluntary program shall be calculated as follows:

             (1)    Determine the amount received for this program per average daily membership as defined in subdivision 13-13-10.1(1) in the prior year;
             (2)    Increase the amount in (1) by the index factor as defined in subdivision 13-13- 10.1(3);
             (3)    Multiply the result of (2) by the average daily membership;
             (4)    Multiply the average daily membership by the per student allocation as defined in this Act;
             (5)    Subtract the index factor from the annual percentage change in the state general fund revenue for the year prior to the year immediately preceding the year of adjustment, the result of which may not exceed 0.5 percent;
             (6)    Multiply the product in (4) by the result of (5);
             (7)    Add the product in (3) to the product in (6).


     Section 4. That § 13-13-72 be amended to read as follows:

     13-13-72.   It is the policy of the Legislature that the appropriation for the state aid to education foundation program increase on an annual basis by the percentage increase in local need on an aggregate statewide basis so that the relative proportion of local need paid by local effort and state aid shall remain constant. However, the increase in the per student allocation on an annual basis that exceeds three percent shall be paid solely by the state and is not a factor in this policy.

     Section 5. The Board of Education shall promulgate rules, pursuant to chapter 1-26, to create an oversight board appointed by the secretary of education for approval of applications, guidelines for district applications based on district instructional goals or market compensation, and a system to monitor the progress of participating school districts with their compensation assistance plans and to ensure that each participating school district is complying with the plan as submitted to the board. Participation in the program is discretionary. District applications shall be approved by the local board of education. The applications shall be reviewed by the teacher compensation assistance program oversight board and shall be recommended to the Board of Education for final approval.

     Section 6. Once a school district's initial five-year plan is complete, the school district may reapply for the program. If a school district reapplies and the district's application is denied by the Board of Education due to changes in the program's requirements, that school district is still entitled to receive funding for this program, if the school district continues to follow its original teacher compensation plan that it followed during the initial five years. The funding that school district is entitled to receive during the first year following the denial and in each year thereafter, as long as the school district continues to follow the original teacher compensation plan, shall be calculated as follows:

             (1)    Determine the amount received for this program per average daily membership as defined in subdivision 13-13-10.1(1) in the prior year;
             (2)    Increase the amount in (1) by the index factor as defined in subdivision 13-13- 10.1(3); and
             (3)    Multiply the result in (2) by the average daily membership."

Dear Mr. Speaker and Members of the House:

I herewith return House Bill 1174 and VETO the same.

House Bill 1174 is entitled, "An Act to increase the maximum amount for which used motor vehicles may be sold or transferred to be exempt from excise tax."

The bill proposes to expand the exemption from excise tax for motor vehicles which are eleven or more model years old. Under current law, such vehicles are exempt from taxation if they are sold for one thousand five hundred dollars or less before trade-in. House Bill 1174 increases the exemption to two thousand two hundred dollars before trade-in. By increasing the exemption, the bill will reduce excise tax collections which would otherwise be deposited in the state highway fund. The state highway fund is used to pay for construction, maintenance and supervision of highways in South Dakota.

The excise tax on a single motor vehicle sale is quite small and therefore has a negligible financial impact on the individual purchaser. However, the collective effect of this bill on the highway fund would be significant. The maximum excise tax savings to the taxpayer under House Bill 1174 is $21.00. The impact to the highway fund is $305,000.00. When matched with federal funds at the four to one ratio, the impact is $1,220,000.00. The excise tax of $21.00 is a fair price to pay for the privilege of using South Dakota's highways and bridges.

At present, our state is struggling to fund necessary construction and maintenance projects for highways and bridges. It would not be prudent to reduce those limited funds. Proper construction and maintenance of highways and bridges help ensure the safety of the traveling public. Reducing the amount available for construction and maintenance projects will result in a decrease in the condition of highways and bridges to the detriment of the traveling public.

Due to the negative impact on funding for highway and bridge construction and maintenance and the questionable benefits of increasing the excise tax exemption, I respectfully request that you concur with my action.

     WHEREAS,  in the year 1882, the small agricultural community of Castlewood burst into bloom in Hamlin County. Castlewood owes its birth to the early growth and extension of

railroad lines into the Dakotas and is named for the engineer on the first train whose name was Castle and for the conductor whose name was Wood; and

     WHEREAS,  the town is situated in the center of one of the richest agricultural sections of northeastern Hamlin County; and

     WHEREAS,  in 1884 a group of thirty-four businessmen signed a petition for an election to establish the Hamlin County court house in Castlewood. Castlewood won the election and the courthouse was established there, but the court house and county seat were transferred to Hayti in 1914; and

     WHEREAS,  Castlewood is now home to 699 residents, and Castlewood is a town of dreams and a wonderful place to come home to:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eighty-second Legislature of the State of South Dakota, that the friends and citizens of Castlewood be honored and remembered during their town's 125th anniversary on June 22, 23, and 24, 2007.

     WHEREAS,  senior Kylie Huether was the 2006 Flight Three Champion in the state:

         A LEGISLATIVE COMMEMORATION,  Congratulating and commending Cadet Colonel Susanna Brazil Marking for receiving the General Carl A. Spaatz Award.

     WHEREAS,  Susanna Brazil Marking is the 1,614th recipient of the General Carl A. Spaatz Award, the first female cadet in South Dakota history to earn this prestigious award, and the first Spaatz Award recipient in the South Dakota Wing in more than eighteen years; and

     WHEREAS,  Cadet Marking serves as the South Dakota Wing Cadet Drill Team Commander; the chairperson of the North Central Region Cadet Advisory Council; and is an active member of the National Cadet Advisory Council; and

     WHEREAS,  Cadet Marking has served as the Cadet Commander of the Joint Dakota Cadet Leadership Encampment and as a representative of South Dakota and the United States as an ambassador in the International Air Cadet Exchange:

     WHEREAS,  Jeanette Nygaard served as an intern with the U.S. State Department at the U.S. Embassy in Berlin, Germany; and

     WHEREAS,  Jeanette Nygaard served the South Dakota Legislature as a Senate page, as secretary for the House minority leadership, and as a legislative aide during the 82nd Legislative Session; and

     WHEREAS,  Jeanette Nygaard recently graduated with honors from South Dakota State University with majors in political science and German:
