    The Committee on Taxation respectfully reports that it has had under consideration SB 41 and returns the same with the recommendation that said bill be amended as follows:

     On page 1 of the printed bill, delete lines 4 to 15 , inclusive, and insert:

"
     Section 1. That § 10-50-6 be amended to read as follows:

     10-50-6.   Any No cigarette on which the tax imposed by this chapter has been paid, such the payment being evidenced by the affixing of such stamp or imprint, is not the stamp required by §  10-50-18 is subject to a further tax under this chapter. However, any person, who possesses two thousand or more cigarettes that do not bear a tax stamp or imprint indicating that the South Dakota cigarette tax has been paid, shall pay the tax imposed pursuant to § 10-50-3 plus a penalty equal to ten percent of the total tax due. Any person who possesses or receives any cigarettes that do not bear a tax stamp indicating that the tax imposed by this chapter has been paid, shall pay the tax imposed pursuant to § 10-50-3, plus interest at the rate of one and

one-quarter percent for each month or part of a month the tax is unpaid, beginning thirty days after the person's first possession or receipt of the cigarettes.

     Any person who possesses or receives:

             (1)    More than two thousand but less than six thousand cigarettes that do not bear a tax stamp indicating that the tax imposed by this chapter has been paid, shall pay the tax imposed pursuant to § 10-50-3, and interest imposed by this Act, plus a penalty of ten percent of the total tax due; and
             (2)    Six thousand or more cigarettes that do not bear a tax stamp indicating that the tax imposed by this chapter has been paid, shall pay the tax imposed pursuant to § 10-50-3, and interest imposed by this Act, plus a penalty of fifty percent of the total tax due.

     In addition to the requirements to pay the tax, penalty, and interest, any person who possesses or receives:

             (1)    Six thousand or more but less than fourteen thousand cigarettes that do not bear a tax stamp indicating that the tax imposed by this chapter has been paid is guilty of a Class 1 misdemeanor; and
             (2)    Fourteen thousand or more cigarettes that do not bear a tax stamp or imprint indicating that the tax imposed by this chapter has been paid is guilty of a Class 4 felony.

     Except as otherwise provided in this section, the provisions of chapter 10-59 apply to the assessment and collection of the tax, penalty, and interest. ".

     On page 2 , delete line 1 .

     On page 2 after line 12, insert:
"
     Section 3. That § 10-50-35 be amended to read as follows:

     10-50-35.   Any cigarettes found at any place in this state without the stamps affixed thereto or without bearing the imprint impressed by a suitable metering machine approved by the secretary of revenue and regulation as required required to be affixed by this chapter unless such cigarettes shall be in the possession of a licensed distributor or wholesaler in the original unopened shipping package or unless they shall be in a course of transit from without this state and consigned to a licensed distributor or a licensed wholesaler are declared to be contraband goods and may be seized by the secretary , his agents, or employees, or by any peace officer of this state when directed by the secretary to do so , without a warrant , unless the cigarettes are in:

             (1)    The possession of a licensed distributor or wholesaler in the original unopened shipping package; or
             (2)    A course of transit from without this state and consigned to a licensed distributor or a licensed wholesaler .

     Section 4. Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.".

     On the previously adopted amendment (41fa), on line 3 of the first subdivision (1), delete " ten " and insert " twenty "

     On line 3 of the first subdivision (2), delete " fifty " and insert " one hundred "

     On page 1, line 2 of the printed bill, after " taxes " insert ", to establish certain penalties, to revise certain provisions regarding the seizure of contraband cigarettes, and to declare an emergency".

    The Committee on Legislative Procedure respectfully reports that the Office of Engrossing and Enrolling has carefully compared HB 1017, 1076, 1172, 1225, 1245, 1265, and 1277 and finds the same correctly enrolled.

     HB 1017: FOR AN ACT ENTITLED, An Act to  make an appropriation from the coordinated soil and water conservation fund to the State Conservation Commission.

     HB 1076: FOR AN ACT ENTITLED, An Act to  make an appropriation for costs related to disasters in the state and to declare an emergency.

     HB 1172: FOR AN ACT ENTITLED, An Act to  clarify certain limits placed on persons lending money.

     HB 1225: FOR AN ACT ENTITLED, An Act to  revise the title of the coordinated soil and water conservation fund and coordinated soil and water conservation plan.

     HB 1245: FOR AN ACT ENTITLED, An Act to  make appropriations from the water and environment fund, the environment and natural resources fee fund, the water pollution control revolving fund subfund, and the drinking water revolving fund subfund for various water and environmental purposes, to revise the state cost share for the Lewis and Clark Rural Water System, and to declare an emergency.

     HB 1265: FOR AN ACT ENTITLED, An Act to  revise certain provisions defining renewable energy and recycled energy.

     HB 1277: FOR AN ACT ENTITLED, An Act to  allow temporary contractual agreements between certain school districts to exist for an additional year.

COMMEMORATIONS


     HC 1012   Introduced by:  Representatives Nelson, Boomgarden, Burg, Carson, Cutler, Davis, Halverson, Kirkeby, Koistinen, McLaughlin, Noem, Novstrup (David), Rounds, and Sigdestad and Senator Greenfield

         A LEGISLATIVE COMMEMORATION,  Honoring the friends and citizens of Lake Norden during their town's one hundredth anniversary.

     WHEREAS,  in the fall of 1906 a group of farmers met in the Roisum school house to determine a way to convince the South Dakota Central Railroad Company to service their area. Once the railroad was located, J.L. Wagner platted a townsite on Tuesday, October 15, 1907, and on October 17, 1907, building began in this new area; and

     WHEREAS,  the future for this quaint community of Lake Norden was so bright that the towns of Dolph and Poinsett pulled up stakes and relocated there. This area became known as Lake Norden because Iver C. Gilbertson thought it appropriate to name the town and nearby lake for "Norden er et Saskenlag", a song he enjoyed; and

     WHEREAS,  Lake Norden is now home to four hundred thirty hardy souls. Lake Norden is a town of dreams and a wonderful place to come home to:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eighty-second Legislature of the State of South Dakota, that the friends and citizens of Lake Norden be honored and remembered during their town's centennial to be celebrated July 6-8, 2007.
