     The Senate convened at 2:00 p.m., pursuant to adjournment, the President presiding.

     The prayer was offered by the Chaplain, Deacon Roger Heidt, followed by the Pledge of Allegiance led by Senate page Delci Christensen.

     The Committee on Legislative Procedure respectfully reports that the Secretary of the Senate has had under consideration the Senate Journal of the twenty-seventh day and finds that the following correction should be made:

    "On page 566 of the Senate Journal, delete lines 23 through 29, inclusive."
        
    The correct committee report is found on page 571 of the Senate Journal.

MOTIONS AND RESOLUTIONS


     SCR 7   Introduced by:  Senators Kloucek, Apa, Hoerth, Lintz, and Maher and Representatives Nelson, DeVries, Gassman, Jerke, Kirkeby, Noem, and Olson (Betty)

         A CONCURRENT RESOLUTION,  Urging that the United States withdraw from the Security and Prosperity Partnership of North America and any other bilateral or multilateral activity that seeks to create a North American Union.

     WHEREAS,  President George W. Bush established the Security and Prosperity Partnership (SPP) of North America, with the nations of Mexico and Canada on March 23, 2005; and

     WHEREAS,  a television reporter asked President Bush on March 23, 2005, whether in light of the European Union the SPP was a step towards continental integration, and the President responded, "...So that the vision that you asked about in your question as to what kind of union might there be, I see one based upon free trade, that would then entail commitment to markets and democracy, transparency, rule of law...,"; and

     WHEREAS,  the gradual creation of such a North American Union from a merger of the United States, Mexico, and Canada would be a direct threat to the Constitution and national independence of the United States, and would imply an eventual end to national borders within North America; and

     WHEREAS,  a White House news release confirmed the continuing existence of the SPP and its "ongoing process of cooperation" on March 31, 2006; and

     WHEREAS,  Congressman Ron Paul has written that a key to the SPP plan is an extensive new NAFTA superhighway that would stretch from Canada into Mexico, through the state of Texas; and

     WHEREAS,  this trilateral partnership to develop a North American Union has never been presented to Congress as an agreement or treaty and has had virtually no congressional oversight; and

     WHEREAS,  state and local governments throughout the United States would be negatively impacted by the SPP/North American Union process, such as the "open borders" vision of the SPP, eminent domain takings of private property along the planned superhighways, and increased law enforcement problems along those same superhighways:

     NOW, THEREFORE, BE IT RESOLVED,  by the Senate of the Eighty-second Legislature of the State of South Dakota, the House of Representatives concurring therein, that the Congress of the United States, and particularly, the legislative delegation to Congress of the State of South Dakota, are hereby urged and petitioned to use all of their efforts, energies, and diligence to withdraw the United States from any further participation in the Security and Prosperity Partnership of North America and any other bilateral or multilateral activity however named that seeks to advance, authorize, fund, or in any way promote the creation of any structure to accomplish any form of North American Union as described in this resolution.

     SB 84:   FOR AN ACT ENTITLED, An Act to   establish the special invasive weed and pest management fund and to increase the pesticide registration fee.

     On the Senate Government Operations and Audit Committee engrossed bill, delete everything after the enacting clause and insert:

    "Section 1. That § 37-21-9.1 be amended to read as follows:

     37-21-9.1.   The Division of Commercial Inspection and Licensing shall charge and collect a maximum ten dollar fee for each inspection and testing of any weight, measure, and weighing and measuring device. From July 1, 2007, through June 30, 2008, the fee is sixteen dollars. From July 1, 2008, through June 30, 2009, the fee is twenty-two dollars. On July 1, 2009, and thereafter, the fee is twenty-eight dollars. The fee shall be paid upon demand of the division by the person, firm, or corporation owning or operating the weight, measure, or weighing or measuring device inspected or tested. A maximum fee of five dollars shall be charged and collected for each inspection and testing of gasoline and diesel stationary fuel pump meters. From July 1, 2007, through June 30, 2008, the fee is eight dollars. From July 1, 2008, through June 30, 2009, the fee is eleven dollars. On July 1, 2009, and thereafter, the fee is fourteen dollars. A maximum fee of fifteen dollars shall be charged and collected for each inspection and testing of gasoline and diesel high speed stationary fuel pump meters and for refined fuel truck meters. From July 1, 2007, through June 30, 2008, the fee is twenty-five dollars. From July 1, 2008, through June 30, 2009, the fee is thirty-six dollars. On July 1, 2009, and thereafter, the fee is forty-six dollars . A maximum fee of fifteen dollars shall be collected for refined fuel truck meters. If a special or emergency inspection is requested, a charge, not to exceed the actual cost of such inspection, including costs for personnel, equipment, and mileage, shall be made and

assessed against the requesting individual or device owner. All fees, except those for special or emergency inspection, shall be promulgated by the secretary of the Department of Public Safety pursuant to chapter 1-26. One-half of the inspection program funding shall be derived from the general fund and the other half from fees collected pursuant to this Act.

         Section 2. That § 37-22-10 be amended to read as follows:

     37-22-10.   The Division of Commercial Inspection and Licensing shall charge and collect a fee for each inspection or testing of scales. The fee shall be paid upon demand of the division by the person, firm, or corporation owning or operating the scale inspected or tested. The maximum schedule of fees is as follows:

                 (1)      Up to and including 2,000 pounds capacity --fifteen dollars :
             (a)    From July 1, 2007, through June 30, 2008 - twenty dollars;
             (b)    From July 1, 2008, through June 30, 2009 - twenty-four dollars;
             (c)    Beginning July 1, 2009 - twenty-nine dollars ;

                 (2)      2,001 to 5,000 pounds capacity, inclusive --twenty-five dollars :
             (a)    From July 1, 2007, through June 30, 2008 - thirty-three dollars;
             (b)    From July 1, 2008, through June 30, 2009 - forty-one dollars;
             (c)    Beginning July 1, 2009 - forty-eight dollars ;

                 (3)      5,001 to 40,000 pounds capacity, inclusive --sixty dollars :
             (a)    From July 1, 2007, through June 30, 2008 - sixty-seven dollars;
             (b)    From July 1, 2008, through June 30, 2009 - seventy-five dollars;
             (c)    Beginning July 1, 2009 - eighty-two dollars ;

                 (4)      Over 40,000 pounds capacity --seventy-five dollars :
             (a)    From July 1, 2007, through June 30, 2008 - eighty-four dollars;
             (b)    From July 1, 2008, through June 30, 2009 - ninety-four dollars;
             (c)    Beginning July 1, 2009 - one hundred three dollars ;

                 (5)      All livestock scales --one hundred dollars :
             (a)    From July 1, 2007, through June 30, 2008 - one hundred twenty-four dollars;
             (b)    From July 1, 2008, through June 30, 2009 - one hundred forty-eight dollars;
             (c)    Beginning July 1, 2009 - one hundred seventy-three dollars .

         If a special or emergency inspection is requested, a charge, not to exceed the actual cost of such inspection, including costs for personnel, equipment, and mileage, shall be made and assessed against the requesting individual or device owner. One-half of the inspection program funding shall be derived from the general fund and the other half from fees collected pursuant to this Act.

         Section 3. That § 34-39-3 be amended to read as follows:

     34-39-3.   The Department of Public Safety may test all weighing and measuring devices used in the wholesale or retail sale of liquefied petroleum gas, either in liquid or vapor form, and shall condemn or reject for repair, any device which is found either to be inaccurate or does not

clearly state the quantity of liquefied petroleum gas, either in liquid or vapor form, in pounds, gallons, cubic feet, or other unit approved by the department.

         The department shall charge and collect a maximum twenty-dollar fee for each test. The fee shall be promulgated by the secretary of public safety pursuant to chapter 1-26. From July 1, 2007, through June 30, 2008, the fee is thirty-six dollars. From July 1, 2008, through June 30, 2009, the fee is fifty-two dollars. On July 1, 2009, and thereafter, the fee is sixty-eight dollars. Revenue from the fee shall be deposited into the state general fund.

         Any inspector employed by the department may enter and examine any liquefied petroleum gas plant for safety standard purposes no more than every two years, except for any reinspection resulting from a deficiency. The department shall charge and collect a maximum one hundred dollar fee for each inspection. The fee shall be promulgated by the secretary of public safety pursuant to chapter 1-26. From July 1, 2007, through June 30, 2008, the fee is fifty-eight dollars. From July 1, 2008, through June 30, 2009, the fee is seventy-six dollars. On July 1, 2009, and thereafter, the fee is ninety-four dollars.

         For the purposes of this section, a liquefied petroleum gas plant is a retail distribution facility with a capacity of at least eight thousand gallons. One-half of the inspection program funding shall be derived from the general fund and the other half from fees collected pursuant to this Act.

         Section 4. That § 37-21A-3 be amended to read as follows:

     37-21A-3.   The director shall charge an annual registration fee of twenty-five dollars per for service agency plus five dollars per agencies and for registered serviceman servicemen to cover administrative costs. From July 1, 2007, through June 30, 2008, the fee for each agency is forty dollars and the fee for each serviceman is seven dollars. From July 1, 2008, through June 30, 2009, the fee for each agency is fifty-five dollars and the fee for each serviceman is eight dollars. On July 1, 2009, and thereafter, the fee for each agency is sixty-nine dollars and the fee for each serviceman is ten dollars. The fee shall be paid when the registration or renewal application is made. One-half of the inspection program funding shall be derived from the general fund and the other half from fees collected pursuant to this Act.

         Section 5. That § 37-21A-7 be amended to read as follows:

     37-21A-7.   A registered serviceman and a registered service agency shall submit, annually to the director, for examination and certification, any standards and testing equipment that are used, or are to be used, in the performance of the service and testing functions with respect to weighing and measuring devices for which competence is registered. No registered service person or agency may use in servicing any commercial weighing or measuring device any standards or testing equipment that have not been certified by the director. The Department of Public Safety shall charge a fee not to exceed the actual cost of for such examination and certification , including costs for personnel, equipment, and mileage . From July 1, 2007, through June 30, 2008, the fee is sixty-two dollars per hour. From July 1, 2008, through June 30, 2009, the fee is seventy-nine dollars per hour. On July 1, 2009, and thereafter, the fee is ninety-six dollars per hour. One-half of the inspection program funding shall be derived from the general fund and the other half from fees collected pursuant to this Act. "

         A LEGISLATIVE COMMEMORATION,  Recognizing and congratulating the Scotland Highlander Football Team for winning the 2006 State Class 9A Football Championship.

     WHEREAS,  the Scotland team overcame much adversity, including many injuries, to get healthy in time to make a run in the playoffs, to achieve an 8-4 overall record, and to become the state champions; and

     WHEREAS,  the team included head coach Bob Graham; assistant coaches Kevin Janish and Joe Walloch; managers John Settje, Carl Evenson, Seth Ireland, Kreg Kepplinger; statisticians Molly Kokesh, Katie Sedlacek, Kyle Behl, and Kelly Sternhagen; cheerleaders Shantel Geiman, Karla Rokusek, Amber Kruse, Ashley Fisher, Natasha Fischer, and Cindy Syrovatka; cheerleader coach Ashley Ulmer; and athletic director Jim Kocer; and
