     The prayer was offered by the Chaplain, Pastor Harvey Friez, followed by the Pledge of Allegiance led by Senate pages Blaine Reynolds and Sara Berg.

     WHEREAS,  domestic livestock producers deserve fair and honest representation in the international marketplace for meat products derived from their livestock; and

     WHEREAS,  United States livestock producers are committed to producing meat products of high quality and fulfill consumer desires for food safety and nutritional value; and

     WHEREAS,  Congress has passed Federal Country of Origin Labeling (COOL) laws, supported by the Seventy-fourth South Dakota Legislature under HCR 1017; and

     WHEREAS,  Congress has not fully funded COOL laws that pertain to South Dakota agricultural products; and

     WHEREAS,  South Dakota's congressional delegation, including Representative Stephanie Herseth, Senator Tim Johnson, and Senator John Thune have endorsed implementation of COOL laws by September 30, 2007:

     NOW, THEREFORE, BE IT RESOLVED,  by the Senate of the Eighty-second Legislature of the State of South Dakota, the House of Representatives concurring therein, that the South Dakota Legislature supports legislation requiring mandatory COOL laws to be implemented by September 30, 2007.

     HCR 1007:   A CONCURRENT RESOLUTION,   Encouraging the Legislature of the State of South Dakota to continue in its practice and to further examine using people first language, which will acknowledge individuals as people before they acknowledge any disability.

     Sen. Knudson moved that SB 169 be further amended as follows:

     On the Senate State Affairs Committee engrossed bill, delete everything after the enacting clause and insert:

    "Section 1. A legislative ethics committee is established consisting of five members from the Senate and five members from the House of Representatives. The president pro tempore in consultation with the minority leader of the Senate and the speaker of the House of Representatives in consultation with the minority leader of the House of Representatives shall appoint their respective members of the ethics committee. No more than three members from each house may be from the same political party.

         Section 2. The ethics committee shall propose, not later than ten legislative days after the beginning of the Eighty-third Session of the South Dakota Legislature, a code of ethics and conflict of interest requirements as new chapters in the joint rules. The ethics committee shall make further recommendations regarding the procedures to be used by the select committees established pursuant to chapter 8 of the Senate rules or chapter 6 of the House rules. Each house

shall consider and act upon the recommendations of the ethics committee within ten legislative days of receipt of the ethics committee's report.

         Section 3. The ethics committee appointed pursuant to section 1 of this Act shall terminate after delivery of its report."

     SB 157:   FOR AN ACT ENTITLED, An Act to   revise the funding for K-12 education and to create a teacher compensation assistance program.

     On page 5 , after line 12, insert:

" ;

                 (12)    "Relative index factor," the net percentage increase in a school district's per student allocation accounting for the change in the index factor and the static nature of the small school adjustment ".

          On page 6, line 5, after " average " insert "increase in its".

          On page 6 , line 5, delete " increases by " and insert "is".

     On page 6 , line 5, before " index " insert "relative".

     On page 10, after line 7 of the Senate Education Committee engrossed bill, insert:

    "Section 14. That § 13-13-73 be amended to read as follows:

     13-13-73.   The secretary of the Department of Education shall compute state aid to education for each school district under the foundation program according to the following calculations:

                 (1)      Determine each school district's average daily membership fall enrollment ;
                 (2)      To arrive at the local need per district:
             (a)     Multiply the per student allocation by the adjusted average daily membership to arrive at the local need per district fall enrollment ;
             (b)    Multiply the small school adjustment, if applicable, by the fall enrollment; and
             (c)    Add the product of subsection (a) to the product of subsection (b);
                 (3)      State aid is (a) local need minus local effort, or (b) zero if the calculation in (a) is a negative number;
                 (4)      If the state aid appropriation for the general support of education is in excess of the entitlement provided for in this section, the excess shall be used to fund any shortfall of the appropriation as provided for in §§ 13-37-36.3 and 13-37-43. The secretary shall report to the Governor by January seventh of each year, the amount of state aid necessary to fully fund the general aid formula in the current year. If a shortfall in the state aid appropriation for general education exists that cannot be covered by § 13- 37-45, the Governor shall inform the Legislature and provide a proposal to eliminate the shortfall. "
