     The Senate convened at 1:00 p.m., pursuant to adjournment, President Pro tempore Gray presiding.

     The prayer was offered by the Chaplain, Dodie Noordermeer, followed by the Pledge of Allegiance led by Senate page Jacob Brakke.

    "Section 1. That chapter 4-5 be amended by adding thereto a NEW SECTION to read as follows:

         There is hereby created in the state treasury the education enhancement tobacco tax fund. All moneys in the education enhancement tobacco tax fund are subject to appropriation by the Legislature through the General Appropriations Act or special appropriations acts for education enhancement programs. Any interest earned shall be credited to the fund.

         Section 2. That chapter 4-5 be amended by adding thereto a NEW SECTION to read as follows:

         There is hereby created in the state treasury the health care tobacco tax fund. All moneys in the health care tobacco tax fund are subject to appropriation by the Legislature through the General Appropriations Act or special appropriations acts for health care related programs. Any interest earned shall be credited to the fund.

         Section 3. That § 10-50-52 be amended to read as follows:

     10-50-52.   The first thirty million dollars in revenue collected annually pursuant to this chapter shall be deposited in the general fund. All revenue in excess of thirty million dollars collected annually shall be deposited in the tobacco prevention and reduction trust fund. Five million dollars of the revenue deposited annually in the tobacco prevention and reduction trust fund pursuant to this section shall be used to implement the tobacco prevention and reduction program. Thirty-three percent of any revenue deposited in the tobacco prevention and reduction trust fund in excess of five million dollars shall be transferred to the property tax reduction fund. Thirty-three percent of any revenue deposited in the tobacco prevention and reduction trust fund in excess of five million dollars shall be transferred to the education enhancement trust tobacco tax fund. Thirty-four percent of any revenue deposited in the tobacco prevention and reduction trust fund in excess of five million dollars shall be transferred to the health care trust tobacco tax fund. "

     13-13-72.1.   Any adjustments in the levies specified in subdivision 13-13-10.1(6) §  10-12- 42 made pursuant to §§ 13-13-71 and 13-13-72 shall be based on maintaining the relationship between statewide local effort as a percentage of statewide local need in the fiscal year succeeding the fiscal year in which the adjustment is made. In addition to the adjustments in the levies provided by this section, the levies for nonagricultural property and owner-occupied single-family dwellings shall also be adjusted as necessary to account for the additional increase in the total assessed value for nonagricultural property and owner-occupied single-family dwellings pursuant to section 1 of this Act. "

No health care facility, physician, nurse, or other person, is required to provide such rape survivor with materials developed and approved pursuant to Section 3 if doing so is contrary to the religious, moral, or ethical tenets of the health care facility, physician, nurse, or other person."

COMMEMORATIONS


     SC 9   Introduced by:  Senator Jerstad and Representatives Steele and Wick

         A LEGISLATIVE COMMEMORATION,  Honoring an outstanding South Dakota businessman, meat processor, and outdoorsman, Leeallen "Lee" Hofer, who passed on recently as he was clearing snow from the pond he created for fishing with his grandchildren.

     WHEREAS,  Leeallen "Lee" Hofer demonstrated an outstanding lifelong dedication to sportsmen and wildlife conservation organizations; and

     WHEREAS,  he served his country in the United States Navy for four years and was a member of the VFW; and

     WHEREAS,  he was actively involved in his community through his work with the Tea airport, the Delapre Township board, and his own business, Lee's Meats and Sausages, in which, he perfected the art of processing game meat; and

     WHEREAS,  he maintained an unwavering dedication to his family, including his wife, Doris; his children, Valerie, Rhonda, and Chris; his grandchildren, Joslyn, Zach, Jordan, Aubrey, Ariana, Bethany, Rachel, Tristan, Ethan, and Aidan; and his great-grandchild Elijah:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eighty-second Legislature of the State of South Dakota, that Leeallen "Lee" Hofer be honored for his lifelong dedication to sportsmen and wildlife endeavors, his country, his community, and his family.

     Sen. Jerstad moved that the Senate do now adjourn, which motion prevailed and at 1:35 p.m. the Senate adjourned.
