REPORT OF CONFERENCE COMMITTEE


MR. PRESIDENT:

     The Conference Committee respectfully reports that it has considered HB 1128 and the amendments thereto made by the Senate, and the disagreement of the two houses thereon, and recommends that HB 1128 be amended as follows:

     On page 1 of the Senate Taxation Committee engrossed bill, delete lines 5 to 11 , inclusive, and insert:

    "10-6-33.25. For the purposes of § 10-6-33.24, the agricultural income value shall be determined using capitalized annual cash rent. The annual cash rent is the annual cash rent, excluding the per acre tax on agricultural land, determined through an analysis of arms-length rental agreements collected within the county in the three years prior to the year for which the agricultural income value is being determined. The agricultural income value of cropland shall be based on average rents over a three-year period for cropland under natural conditions. The agricultural income value of noncropland shall be based on average rents over a three-year period for noncropland under natural conditions. However, no arms-length rental agreements for irrigated land may be used to determine the annual cash rent pursuant to this section. The annual cash rent shall be capitalized at seven and three-fourths six and one-fifth percent.


         The secretary of revenue and regulation may enter into a contract for the collection of cash rent information by county. Cash rent information shall be adjusted by soil survey statistics, if available, and pursuant to § 10-6-33.26.

         Section 2. This Act is repealed on July 1, 2007."

     WHEREAS,  Pat Adam has dutifully served the Legislature for eleven years as First Assistant of the Senate and then as Secretary of the Senate; and

     WHEREAS,  Pat Adam, born into politics as the daughter of former Governor George Theodore Mickelson and the sister of former Governor George Speaker Mickelson, has worked on various statewide campaigns and served as a delegate to national committees; and

     WHEREAS,  Pat Adam is the loving wife of Thomas Adam, the caring mother of Kathleen, Paula, Karl, and Sarah, as well as the devoted grandmother of fourteen grandchildren; and

     WHEREAS,  Pat Adam has shown her commitment to serving South Dakota through her active involvement in numerous organizations. Her accomplishments include active membership in the First United Methodist Church, the South Dakota Community Foundation, the State Historical Society which she served as president, the Pierre School Board, and the board of Children's Care Hospital. Pat also served as a Girls' State mentor and as a devoted fund-raiser for the Pierre YMCA; and

     WHEREAS,  Pat Adam has devoted much of her life to service and politics, and the Senate is privileged to have been the beneficiary of her knowledge and demeanor for eleven years:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eighty-first Legislature of the State of South Dakota, that Patricia (Pat) Adam be commemorated for her exceptional service to the State of South Dakota and the South Dakota Senate.
