Dear Speaker Michels and Members of the House:

I hereby return House Bill 1141 and, pursuant to Article IV, Section 4, I hereby veto House Bill 1141.

House Bill 1141 is "An Act to provide standards for interpreting for the deaf and hard-of-hearing by requiring national interpreter certification and to repeal the state certification process and replace it with registration." The intent of House Bill 1141 is to establish standards for interpreting for the deaf and hard of hearing. I agree with this premise and support the sponsor's intent. The problem appears to have occurred when the bill was drafted. The problem with House Bill 1141 as it appears before me is that it unconstitutionally delegates legislative authority on page 2, section 4. Simply put, future legislatures cannot be bound to standards and criteria not yet determined by the associations or groups in the future as provided in House Bill 1141. Specifically, the legislature would be committing future legislatures to any changes in the standards or criteria for certification by the Registry of Interpreters, the National Association of the Deaf, and the Educational Interpreters Proficiency Assessment.

I respectfully request you concur with my veto of House Bill 1141.

     WHEREAS,  Katie Keegan, Jenny Poppen, Sara Rogers, Katie Breuer, Heidi Mogck, Kassie Finck, Heather Williams, Katie Mackenzie, Theresa Knapp, and Katelyn Walker through hard work and dedication achieved this honor; and

     WHEREAS,  coaches Maridee Dossett and Kindra Norby put forth the time and effort to train and practice with the Madison Lady Bulldogs volleyball team:

         A LEGISLATIVE COMMEMORATION,  Honoring Stephanie Cooper of Brookings, South Dakota, and Brianne Nelson of Volga, South Dakota, on being named among the top youth volunteers in South Dakota for 2006, in the annual Prudential Spirit of Community Awards.

     WHEREAS,  the Prudential Spirit of Community Awards, created in 1995, are designed to emphasize the importance our nation places on service to others, and to encourage young Americans of all backgrounds to contribute to their communities; and

     WHEREAS,  Stephanie Cooper, a senior at Brookings High School, has been an active volunteer in the activities for National Family Month, sponsored by her school's Family, Career, and Community Leaders of America chapter; and

     WHEREAS,  Brianne Nelson organized service projects focusing on helping children in need by conducting research, recruiting volunteers, and implementing a variety of charitable events for needy children; and

     WHEREAS,  these recipients are recognized for vividly demonstrating that young people across America are making remarkable contributions to the health and vitality of their communities:

         A LEGISLATIVE COMMEMORATION,  Honoring Alcester-Hudson Elementary School for being named as a No Child Left Behind Blue Ribbon School for 2005.

     WHEREAS,  upon receiving notice in 2001 from the South Dakota Department of Education that their school would be placed in the "school improvement" category, Alcester-Hudson Elementary School's students, teachers, and administrators undertook a successful effort to improve their school's testing acumen. In order to facilitate change, the district created a School Improvement Leadership Team comprised of teachers, administrators, parents, and community members, and consulted with Mid-Continent Research for Education and Learning for assistance in developing a plan of action; and

     WHEREAS,  the Alcester-Hudson Elementary School teachers cooperated to ensure daily, uninterrupted instruction in language arts and mathematics and utilized professional development to ensure that all teachers were consistent in their use of curriculum, along with "Teacher Team Meetings," or professional development opportunities held during the school day in which school and education issues were discussed and professional learning activities were adopted, thereby solidifying the "Team" feeling at the school; and

     WHEREAS,  the result of this hard work is evident in the superb testing scores of the student body of Alcester-Hudson Elementary, which has scored between 93 percent and 100 percent on all-school proficiency the last three years in both reading and mathematics, with the monumental efforts of the third and fourth grade students who have alone attained 100 percent proficiency in both reading and mathematics for three continuous years. The district leadership and administrative officials had the foresight and desire necessary to create a sound strategy for improving teaching methods and creating professional learning activities that serve as true models of success for our public schools. This honor was bestowed upon only 246 public schools throughout the United States, with only two other schools being chosen from South Dakota:

         A LEGISLATIVE COMMEMORATION,  Honoring Jean Nelson for being named Social Worker of the Year by the East River Intrastate Committee on Child Abuse and Neglect.

     WHEREAS,  Jean Nelson, after completing her college education at the University of South Dakota and achieving her Bachelor's Degree in social work, has served with diligence in her twenty years of service with the South Dakota Department of Social Services, working with both adult services and child protection services; and

     WHEREAS,  Jean serves South Dakota dutifully through hard work, ensuring that numerous at-risk children live free of abuse and neglect, assisting parents in finding the services they need to better care for their children and assisting foster families in the provision of a safe and nurturing environment for South Dakota's children. By amply embodying the qualities of patience, compassion, energy, and care that are prerequisites for a capable social worker, Jean acts as one of our best hopes for securing a brighter future for this state's youngest and most vulnerable; and

     WHEREAS,  the protection of South Dakota's children, providing services to families, and the strength of our communities depend in great measure upon the dedication of people like Jean Nelson who use their talents and resources to serve others; and

     WHEREAS,  Jean continues serving her community today, whether through her job as a social worker or as an active volunteer at her local church. Jean has raised a dedicated family that can attest to these many qualities, including her husband Ron, her son Trent, her daughter Tracy, and two wonderful grandchildren:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eighty-first Legislature of the State of South Dakota, that Jean Nelson be congratulated for being named Social Worker of the Year.
