     The Senate convened at 9:30 a.m., pursuant to adjournment, the President presiding.

     The prayer was offered by the Chaplain, Pastor Theodora Boolin, followed by the Pledge of Allegiance led by Senate page Eli McGehee.

APPROVAL OF THE JOURNAL


MR. PRESIDENT:

     The Committee on Legislative Procedure respectfully reports that the Secretary of the Senate has had under consideration the Senate Journal of the thirty-seventh day.

     All errors, typographical or otherwise, are duly marked in the temporary journal for correction.

MESSAGES FROM THE HOUSE


MR. PRESIDENT:

    I have the honor to inform your honorable body that the House has adopted the report of the Conference Committee on SB 143.

    I have the honor to inform your honorable body that the House has concurred in Senate amendments to HB 1042, 1093, 1139, 1152, 1202, 1233, 1240, and 1248.

Also MR. PRESIDENT:

    I have the honor to inform your honorable body that the House has appointed Reps. Dykstra, Heineman, and Halverson as a committee of three on the part of the House to meet with a like committee on the part of the Senate to adjust the differences between the two houses on SB 157.

Also MR. PRESIDENT:

CONSIDERATION OF EXECUTIVE VETOES AND RECOMMENDATIONS


     The Senate proceeded to the reconsideration of HB 1100 pursuant to the veto of the Governor and the veto message found on page 706 of the House Journal as provided in Article IV, Section 4, of the Constitution of the State of South Dakota.

     The question being "Shall HB 1100 pass, the veto of the Governor notwithstanding?"

     And the roll being called:

     The Senate proceeded to the reconsideration of HB 1181 pursuant to the veto of the Governor and the veto message found on page 708 of the House Journal as provided in Article IV, Section 4, of the Constitution of the State of South Dakota.

REPORT OF CONFERENCE COMMITTEE


MR. PRESIDENT:

     The Conference Committee respectfully reports that it has considered SB 43 and the amendments thereto made by the House, and the disagreement of the two houses thereon, and recommends that SB 43 be amended as follows:

     On page 3, line 3 of the House Judiciary Committee engrossed bill, after " felony. " insert " However, a violation of subdivision (7) is a Class 2 felony. A second or subsequent violation of subdivision (7) is a Class 1 felony. ".

     On page 49, line 23, delete " first degree " .

     On page 50 , line 2, delete " first degree " .

     HCR 1018:   A CONCURRENT RESOLUTION,   Requesting South Dakota's Congressional delegation and the United States Congress to support federal multi-emission reduction legislation.
