Dear Mr. President and Members of the Senate:
I hereby return Senate Bill 99 and VETO the same. It is "An Act to permit financial institutions
to prepay future tax liabilities."
Senate Bill 99 would allow for financial institutions to pay a tax directly to the county that has
heretofore been paid directly to the state. The State of South Dakota has the statutory duty to
administer this tax, including the audit function under SDCL 10-43.
I understand the intention of Senate Bill 99 and have no serious reservations about its intent.
My reservations are grounded in the State's ability to perform the audit function over the ten
year period which is allowed under Senate Bill 99. There are no provisions for notice by either
the county or the financial institution to the State of South Dakota of future liabilities being
paid. Without a clear audit trail for the State of South Dakota to rely upon, it is doubtful that
a meaningful audit could be made which would stand legal challenges. I would anticipate
considerable difficulty in complying with the State of South Dakota's statutory duty to
accurately and fairly administer this tax.
I respectfully request that you concur with my action.
