     The prayer was offered by the Chaplain, Pastor Harvey Friez, followed by the Pledge of Allegiance led by Senate page Kalyn McNenny.

     On the House Taxation Committee engrossed bill, delete everything after the enacting clause and insert:

    "Section 1. That section 2 of House Bill 1261 as previously enacted by the 2005 South Dakota Legislature be amended to read as follows:

     For the purposes of this Act, the term, new business facility, means a new building or structure or the expansion of an existing building or structure , including a power generation facility, the construction of which is subject to the contractor's excise tax pursuant to chapter 10-46A or 10-46B. A new business facility does not include any building or structure:

             (1)    Used predominantly for the sale of products at retail, other than the sale of electricity at retail, to individual consumers;
             (2)    Used predominantly for residential housing or transient lodging;
             (3)    Used predominantly to provide health care services; or
             (4)    That is not subject to ad valorem real property taxation or equivalent taxes measured by gross receipts.

     Section 2. That § 10-45B-6 be amended to read as follows:

     10-45B-6.   Any person desiring to claim a refund pursuant to § 10-45B-2 this chapter shall apply for a permit from the secretary at least thirty days prior to commencement of the project the construction date. However, any project with a construction date between February 1, 2005, and July 1, 2005, that would otherwise qualify for a refund shall apply for a permit by August 1, 2005 . The application for a permit shall be submitted on a form prescribed by the secretary. A separate application shall be made and submitted for each project. Upon approval of the application, the secretary shall issue a permit entitling the applicant to submit refund claims as provided by §§ 10-45B-7 and 10-45B-8. Such permit or refund claims are not assignable or transferable except as collateral or security pursuant to chapter 57A-9. "

     For the purposes of this chapter, a condition statement is a document that identifies a fund's beginning balance, receipts, disbursements, and ending balance for each of the last two concluded fiscal years and that identifies a fund's beginning balance, projected receipts, projected disbursements, and ending balance for the current fiscal year and the next fiscal year. The fund's ending balance, for the current fiscal year and the next fiscal year, shall represent the ending cash balance of the fund reduced by any money that is reappropriated to the next fiscal year along with any other commitments to be funded from the ending cash balance. Condition statement forms, prescribed by the Bureau of Finance and Management, shall be uniform."

    "Section 2. That chapter 10-43 be amended by adding thereto a NEW SECTION to read as follows:

     A financial institution may deposit with the secretary of revenue and regulation an amount determined by the financial institution to be applied toward the future tax liability of the financial institution under this chapter to the extent of the share of the tax the state would be required to remit to the county. The secretary of revenue and regulation shall remit, as provided in §  10-43-76, the amount of the deposit to the county or counties where the financial institution does business. The secretary of revenue and regulation shall record any deposit received pursuant to this section as a credit toward the future tax liability of the financial institution. No interest may accrue on any deposit received pursuant to this section.

     If any amount deposited pursuant to this section is not applied to the financial institution's tax liability under this chapter within ten years of the date of deposit, the secretary of revenue and regulation shall refund the amount of any remaining deposit to the financial institution.".

     HB 1098: FOR AN ACT ENTITLED, An Act to  clarify certain provisions related to the terms of conservation easements.

     HB 1188: FOR AN ACT ENTITLED, An Act to  revise certain provisions regarding amounts payable under reinsurance contracts in liquidation proceedings of insurers.

     HB 1197: FOR AN ACT ENTITLED, An Act to  continue certain restrictions on the use of artificial lights to hunt or locate wild animals.


     HB 1228: FOR AN ACT ENTITLED, An Act to  revise certain provisions regarding unemployment insurance.

COMMEMORATIONS


     SC 18   Introduced by:  Senators Kloucek and Moore and Representatives Putnam, Gassman, and Jerke

         A LEGISLATIVE COMMEMORATION,  Recognizing the Menno Pioneer Power Show.

     WHEREAS,  the 19th annual Menno Pioneer Power Show will be held in Menno, South Dakota, on September 24 and 25, 2005; and

     WHEREAS,  the show will feature the historic Allis Chalmers tractor line, the Maytag stationary engine, and the Buick car line; and

     WHEREAS,  events will include an antique tractor pull, two antique car and tractor parades, steam engine plowing and threshing, corn chopping, corn cutting and binding, and a mini-rod tractor pull; and

     WHEREAS,  the Menno Pioneer Power Show also includes a flea market and crafts fair, a toy show, and a pancake and sausage breakfast and lunch sponsored by the Menno Community Club:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eightieth Legislature of the State of South Dakota, that the Menno Pioneer Power Show Committee, the Menno Community Club, and the entire Menno community be commended for all their hard work and congratulated for a job well done.

     Sen. Dan Sutton moved that the Senate do now adjourn, which motion prevailed and at 3:00 p.m. the Senate adjourned.
