     HCR 1012   Introduced by:  Representatives Lange, Bradford, Dennert, Gassman, Gillespie, Glenski, Glover, Kroger, Miles, Roberts, Sigdestad, Street, Thompson, and Van Norman and Senator Kloucek

         A CONCURRENT RESOLUTION,  Urging Congress to close the School of the Americas at Fort Benning, Georgia.

     WHEREAS,  the United States Army School of the Americas (SOA), located at Ft. Benning, Georgia, has trained nearly 50,000 military officers from throughout Central and South America and the Caribbean; and

     WHEREAS,  more than sixty percent of the Salvadoran military officers cited in the 1993 United Nations Truth Commission report for massacres, assassinations, and other human rights abuses, were graduates of the SOA; and

     WHEREAS,  more than forty percent of Colombian officers cited by an international human rights tribunal were graduates of the SOA; and

     WHEREAS,  many of the top military officials involved in Mexico's counterinsurgency war in Chiapas are SOA graduates; and

     WHEREAS,  many graduates of the SOA have been indicted for human rights abuses and drug trafficking in Argentina, Bolivia, Chile, Colombia, El Salvador, Guatemala, Honduras, Panama, and Peru, including Gen. Manuel Noriega of Panama, Roberto D'Aubisson of El Salvador, Gen. Hector Gramajo of Guatemala, and Gen. Hugo Banzar of Bolivia; and

     WHEREAS,  human rights observers, church leaders, peasant organizations, and student and lawyers' groups have identified numerous SOA graduates as responsible for acts of torture, assassination, kidnapping, drug trafficking, disappearances, rape, and death squad activity throughout Latin America; and

     WHEREAS,  the United States Department of Defense revealed in 1996 that training manuals used at the SOA included sections on torture, execution, blackmail, and paying bounties for the assassinations of community leaders; and

     WHEREAS,  the history of the SOA runs contrary to our principles of respect for human rights:

     NOW, THEREFORE, BE IT RESOLVED,  by the House of Representatives of the Eightieth Legislature of the State of South Dakota, the Senate concurring therein, that the South Dakota Legislature calls upon the United States Congress and the Executive Branch to eliminate funding for and close the School of the Americas at Ft. Benning, Georgia.

     Was read the first time and the Speaker waived the committee referral.

     Rep. Lange moved that the Committee on Agriculture and Natural Resources be instructed to deliver HB 1232 to the floor of the House, pursuant to Joint Rule 7-7.

     Which motion was not supported.

     HB 1210:   FOR AN ACT ENTITLED, An Act to   exempt certain contract services from sales and use taxes.

     Rep. Davis moved that HB 1210 be amended as follows:

     On page 1 of the House Taxation Committee engrossed bill, delete lines 6 to 13 , inclusive, and insert:

"

     There are specifically exempted from the provisions of this chapter and from the computation of the tax imposed by it, gross receipts from management, specialist, billing, bookkeeping, administrative, and related services provided to a local cooperative by a regional cooperative, or any cooperative or limited liability company which is wholly or in part owned by the cooperative or limited liability company receiving such services. If such cooperative or limited liability company is owned in part, the cooperative or any combination of cooperatives shall own fifty percent or more of such cooperative or limited liability company receiving such services to be qualified for the exemption provided by this section.".

     On page 2 , delete lines 2 to 9 , inclusive, and insert:

"

     There are specifically exempted from the provisions of this chapter and from the computation of the tax imposed by it, gross receipts from management, specialist, billing, bookkeeping, administrative, and related services provided to a local cooperative by a regional cooperative, or any cooperative or limited liability company which is wholly or in part owned by the cooperative or limited liability company receiving such services. COMMEMORATIONS


     HC 1019   Introduced by:  Representatives Elliott, Dennert, Frost, and Novstrup and Senators Hundstad and Sutton (Duane)

         A LEGISLATIVE COMMEMORATION,  Honoring the life and career of Earl Sande, a professional jockey during the 1920s.

     WHEREAS,  Earl Sande was born November 13, 1898, at Groton, South Dakota, to John and Tillie Sande. He learned to ride horses on H.W. Cassel's farm; and

     WHEREAS,  Earl Sande went on to become one of the top jockeys of all time, with five Belmont Stakes wins; three Kentucky Derby wins; one Preakness win; one Triple Crown win riding Gallant Fox, making him one of only eleven jockeys to win a triple crown; five Jockey Club Gold Cups; four Withers Stakes; three Lawrence Realizations; three Suburban Handicaps; three Dwyer Stakes; third on the Lifetime Winning Percentage List; and more than sixty percent of all mounts finishing in the money; and

     WHEREAS,  Earl Sande's life and career are described by Richard J. Maturi in his book Triple Crown Winner: the Earl Sande Saga with invaluable help from Stacy and Steve Swenson, publishers and owners of the Groton Independent and the back files of the Independent which were able to establish the residency and livelihood of the Sande family in Groton:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eightieth Legislature of the State of South Dakota, that Earl Sande, a native South Dakotan, who gained national prominence as a jockey in the 1920s, the Golden Age of Sports, is arguably the best all-time jockey America has yet produced.
