    BE IT REMEMBERED, That on the twelfth day of January, A.D., two thousand ten, at the hour of twelve o'clock meridian, on the second Tuesday in January, being the day and hour fixed by the Constitution of the state of South Dakota for the convening of the Legislature, the Eighty-fifth regular session of the House of Representatives in the Capitol, in the city of Pierre, in the county of Hughes, and the state of South Dakota, the seat of government thereof, was called to order by Chris Nelson, the Secretary of State of the state of South Dakota.

    The following prayer was offered by Pastor Daniel Varns, Pierre/Ft. Pierre Ministerial Association, Pierre, South Dakota:

    Heavenly Father, as we gather on this beautiful winter day, I am mindful of the blessings which surround our lives. Thank You for Your watchful care over our lives, and for Your presence as we go through each day. Thank You also for the gift of service. As we open this session of our state legislature, I ask that You would give these servants wisdom and understanding. May they discern the times in which we live, and the best way to meet the needs of those for whom they are responsible. Give them courage to make difficult decisions even when those decisions are right and necessary. May justice, compassion, and integrity guide them in the days ahead. I ask that You would watch over and protect them and their families. May loved ones know a special measure of Your grace as these leaders are away, devoting themselves to the tasks that lie ahead. I ask these things in Your Name. Amen.

        A CONCURRENT RESOLUTION, Urging Congress to pass a balanced, well-funded, multi-year federal highway program which provides connectivity and mobility to both rural and urban areas.

    WHEREAS, Congress has not yet enacted legislation providing for a multi-year reauthorization of the federal highway program, hampering the ability of our state to plan and deliver needed surface transportation improvements to the citizens of South Dakota; and

    WHEREAS, South Dakota serves as a bridge for truck and personal traffic between other states, advancing interstate commerce and mobility; and

    WHEREAS, South Dakota's transportation system supports agricultural exports and serves the nation's domestic energy industries like wind generation and ethanol production, located largely in rural areas; and

    WHEREAS, South Dakota's surface transportation system serves as a lifeline for remotely located and economically challenged citizens, such as those living on tribal reservations; and

    WHEREAS, South Dakota's transportation system enables people and business to traverse the vast acres of sparsely populated land that is characteristic of the western United States; and

    WHEREAS, South Dakota's transportation system provides access to the scenic wonders of Badlands National Park and of Mt. Rushmore and provides a major connection to national parks in other states; and

    WHEREAS, South Dakota has a vast and extensive highway system that serves national as well as state transportation needs, has very few citizens to finance the highway system's maintenance and improvement, and has one of the highest per capita levels of effort in funding transportation in the nation; and

    WHEREAS, because of all the factors listed above, it is essential that South Dakota's transportation system receive a proportion of the national funding equivalent to what it has received in the SAFETEA-LU reauthorization of the federal highway program to keep the state and the nation connected:

    NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the Eighty-fifth Legislature of the State of South Dakota, the Senate concurring therein, that the South

Dakota Legislature strongly supports prompt enactment of a well-funded, multi-year federal surface transportation program that includes a highway funding formula share that is at least as favorable to South Dakota as the current formula in SAFETEA-LU; and

    BE IT FURTHER RESOLVED, that a copy of this resolution be sent to the Majority Leader and Minority Leader of the United States Senate, the President of the United States Senate, the Speaker of the United States House of Representatives, the Chairman of the Senate Environment and Public Works Committee, the Chairman of the House Transportation and Infrastructure Committee, and to each member of South Dakota's congressional delegation.

    Pursuant to the report of the Joint-Select Committee, the Senate convened with the House of Representatives in the House Chamber for the purpose of receiving a message from the Governor, M. Michael Rounds. The President of the Senate, Dennis Daugaard, presided.

    The following prayer was delivered by Pastor Daniel Varns, Pierre/Ft. Pierre Ministerial Association, Pierre, South Dakota:

    Heavenly Father, we gather this afternoon to reflect on where we've been, discern where we are, and determine the direction we need to go. Thank You for Your guidance in the past, Your wisdom for the present, and Your knowledge of the future. We are mindful of the tremendous responsibility that rests on the shoulders of leaders. I ask that You would grant these men and women the grace, patience, and perseverance to carry out these responsibilities. We pray for those of our state who find themselves in need. We ask that You would be with them, and that their needs would be met. Make a way for them at a time when it appears no way exists. Thank You for our elected officials and all who serve with them. Grant them all they need now and in the coming days. Watch over them, their families, their businesses, and all they leave behind while they serve our state. Thank You for hearing our prayers. Amen.
