    "Section 1. That § 10-33-21 be amended to read as follows:

     10-33-21.   All persons, corporations, cooperatives, and associations engaged in furnishing and providing telephone and exchange service comprising rental and toll service by means of wired circuits and otherwise and whose annual gross receipts are less than fifty million dollars shall be taxed on the basis of gross receipts , according to one of the two following schedules at the rate of four percent . Whichever schedule provides the lesser percentage of tax shall be applied by the Department of Revenue:

     However, no telephone company operating in this state shall may be taxed less than an amount equal to fifty cents per year per telephone serviced. Further, each telephone company that was taxed in the five percent tax category for the calendar year 2001 shall pay an amount of tax to each school district of not less than the tax received by such school district in 2002 for the years 2003 and 2004 ; and each year thereafter, the tax paid shall be as provided in SCHEDULE A or SCHEDULE B of this section .

     Section 2. That § 10-33-22 be amended to read as follows:

     10-33-22.   The term, average number of customers per mile of line (density), as used in §   10-33-21 means total number of subscribers, customers, or patrons in this state, divided by the total number of miles of line of such person, company, corporation, cooperative, or association in this state. The term, line, as used in § §   10-33-21 and 10-33-22 shall not necessarily mean a single circuit but shall be the aggregate of all communications transmission circuits, voice or otherwise, and associated attachments and appurtenances thereto. Such persons, corporations, cooperatives, and associations are herein referred to as "companies." The term, company, means any person, corporation, cooperative, association, or other entity providing telephone and exchange service, rental and toll service.

     Section 3. That § 10-33-27 be amended to read as follows:

     10-33-27.   If the tax levied under §   10-33-21 is not paid on the due date a penalty of up to five percent of the amount of the tax shall may be imposed for each month of delinquency, and if any telephone company shall fail fails to report its gross receipts to the secretary of revenue and regulation, said the company shall may be penalized up to twenty-five percent of the tax due. Provided, further, that such Such tax may be enforced and collected by distress and sale of the personal and real property of such company in the same manner as is now provided for the collection of real property taxes and mobile home taxes pursuant to chapter 10-22. The tax levied under §  10-33-21 shall be administered pursuant to chapter 10-59, unless a contrary provision in this chapter applies. "

     HB 1281:   FOR AN ACT ENTITLED, An Act to   provide for certain property tax exemptions for business incubators owned by nonprofits.

    "Section 4. That chapter 10-4 be amended by adding thereto a NEW SECTION to read as follows:

     If any governing body grants a property tax exemption to a business incubator pursuant to section 1 of this Act, any other business located within such governing body is eligible for a property tax exemption. The governing body shall approve the property tax exemption for such business if the business has paid its property taxes in full. The tax exemption for such business shall be approved by the governing body after public notice and hearing and for a period of time as provided to any business incubator by such governing body. If the property tax exemption is renewed for any business incubator, the property tax exemption shall also be renewed for any business."

SECOND READING OF SENATE BILLS AND JOINT RESOLUTIONS


     SB 152:   FOR AN ACT ENTITLED, An Act to   allow school districts to purchase property insurance using capital outlay funds.

     Having had its second reading was up for consideration and final passage.

     Sen. Ed Olson moved that SB 152 be further amended as follows:

     On the printed bill, delete everything after the enacting clause and insert:

    "Section 1. The Department of Education may enter into agreements with the responsible parties from the state of North Dakota for the purpose of allowing an open enrollment policy between South Dakota and North Dakota.

     Section 2. An agreement entered pursuant to this Act shall specify the following:

             (1)    For students who are not residents of South Dakota, the open enrollment policy applies only to students whose school district borders South Dakota;

             (2)    If North Dakota open enrolls more students into South Dakota than South Dakota open enrolls into North Dakota, North Dakota shall pay South Dakota an agreed upon amount for the net number of students open enrolled into South Dakota; and

             (3)    If South Dakota open enrolls more students into North Dakota than North Dakota open enrolls into South Dakota, South Dakota shall pay North Dakota an agreed upon amount for the net number of students open enrolled into North Dakota.

     Section 3. An agreement entered into pursuant to this Act may specify additional terms for students who may be subject to the provisions of chapter 13-37.

Any member of the National Guard of the State of South Dakota who is enrolled in a program leading toward a graduate degree in any state educational institution under the control and management of the Board of Regents, including institutions or courses not subsidized by the general fund, is entitled to a benefit of fifty percent of the in-state resident undergraduate tuition to be paid to the institution by the Department of Military and Veterans Affairs. The benefit provided by this Act may not exceed thirty-two credit hours toward a graduate degree."

     On the House engrossed bill, delete everything after the enacting clause and insert:

    "Section 1. Terms used in this Act mean:

             (1)    "Eligible participant," any person operating a small business in South Dakota or any person attempting to start a small business in South Dakota;

             (2)    "Small business," any business with less than one million dollars in gross sales or projected gross sales;

             (3)    "Reimbursable costs," any tuition and fees, textbooks, workbooks, and other materials paid by an eligible participant in order to take an adult small business management course offered by a postsecondary vocational technical institution.

     Section 2. Each postsecondary technical institute in South Dakota shall establish and offer a course in adult small business management. The curriculum shall include business

management, bookkeeping, and other subjects necessary to complete a small business management curriculum.

     Section 3. Each instructor of an adult small business management course shall have experience in successfully operating and managing a small business. The annual salary paid to each instructor for teaching an adult small business management course may not be less than twenty thousand dollars.

     Section 4. There shall be at least one instructor for each twenty-five students enrolled in an adult small business management course.

     Section 5. There is hereby appropriated from the general fund the sum of two hundred thousand dollars ($200,000) to the Department of Education to pay for start-up costs incurred by the postsecondary vocational technical institutes associated with the establishment and offering of an adult small business management program.

     Section 6. An eligible participant is eligible for reimbursement of reimbursable costs according to the following schedule: first year, one hundred percent of reimbursable costs; second year, seventy-five percent of reimbursable costs; third, fourth, and fifth years, fifty percent of reimbursable costs.

     Section 7. The Department of Education shall pay fifty percent of reimbursable costs to an eligible participant within thirty days of enrollment in the adult small business management program and the remaining fifty percent upon successful completion of the program.

     Section 8. The Department of Education shall promulgate rules, pursuant to chapter 1-26, to establish the adult small business management curriculum and to make payments as provided for in this Act.

     Section 9. Expenditures authorized by this Act shall be paid on warrants drawn by the state auditor on vouchers approved by secretary of the Department of Education."
